Mandal ka Kamanadal will do. What this means is that we are back to square one. All the effort, money and energy was spent on making sure that we didnt get screwed any further. Meaning, it hasnt moved us a step ahead but just helped us to retain our positions without going back.

All three- Lofgren, Eshoo and Pelosi- represent the High Tech areas of California, Silicon Valley and the areas around it. I'm sure there are many immigrants/IV members in those areas. We need to have a webfax and phone campaign to get interim relief now. Folks in that area can viist lawmakers offices too. Maybe CompeteAmerica wants to recapture H1 visas and EB visas for high tech immigrants too??

Agree with you 100%. I have been waiting patiently all along hoping something good would happen for EB3. I am talking to my employer if they can port my case to EB2. I have a master's degree and about 13 years of experience (8 years in the current job). My only concern is if the new EB2 labor or I140 doesn't get approved for some reason, can I fall back to my current EB3 application. I don't want to jeopardize my current application just by deciding to port to EB2. Any suggestions?
If I were you, I would make it clear to the employer that you qualify for tier 1 in UK and educate them on benefits of tier 1 vs waiting for green card then go from there. It worked for me.

I have many positive experiences with Fragomen.
My RIR case was first filed in 2001 by a different lawyer and he screwed it up. It got rejected by DOL and bumped back to non-RIR. When the BEC was about to take the case for processing, my company hired Fragomen for the processing. Fragomen reviewed my case, worked with me, prepared and filed a new Labor petition in 24 hours as I was reaching my 6th year limit.
When PERM was introduced, they worked with me to convert my traditional labor filing to PERM.
During the July VISA bulletin fiasco, they kept communicating well and worked overtime (I used to get emails around midnight sometimes) and filed my case. They even followed up and made sure that I was going to attend my finger printing appt when they got the courtesy copy.
They do well with email replies. I have never called them and hence, not sure about responding to calls. But I never had a requirement to call them as they normally reply to emails within 1 working day.
Since Fragomen is so big, they might have a small percentage of attorneys / para legals who are not customer focussed. I have dealt with 3 different attorneys / para legals withing Fragomen, and I have high regards for them.
My emails just go to a black box who no one opens....

I think we can wait till Aug 15th for I-140 receipt and if we don't get that (:( :mad: :confused: ) then we can file I-485 with the mailroom instructions from the FAQ (:) :) )

This does not seem to be a 485 RFE but a H1 RFE. Put some sense into the post before posting here and confusing people. How can yours be a 485 RFE when employer X never sponsored your GC and when USCIS is asking paystubs from Employer X for H1 transfer and when your GC is still running with Employer 2. Senseless post.

Frustrated by the Senate Judiciary Committee's slow progress on politically sensitive immigration legislation, Senate Majority Leader Bill Frist (R-Tenn.) introduced his own bill last night to secure the nation's borders and crack down on illegal immigration.
Frist's bill will go directly to the full Senate. But he said he will allow Senate Judiciary Committee Chairman Arlen Specter (R-Pa.) to substitute a committee bill if Specter's panel could approve one March 27. Otherwise, the majority leader will stick to a strict, two-week schedule to finish work on what he conceded would be "as challenging a bill as any we'll have to address this year."
The majority leader's power move stunned committee Republicans and Democrats, who have been struggling for three weeks to reach agreement on a comprehensive immigration bill. Specter said he objected to the maneuver.
"It would be chaos on the floor to have this bill debated without the committee acting first," Specter said yesterday afternoon, only to grudgingly accept Frist's move in the evening.
Some Republican aides said they believed presidential politics were at work. Frist, a prospective candidate for 2008, left out of his bill the guest-worker program that President Bush has demanded and Sen. John McCain (R-Ariz.) -- a potential White House rival -- has championed. Such a program is unpopular with many conservative voters, who see it as amnesty for illegal immigrants. Many Republicans believe a new law to get tough on illegal immigrants is one of the few pieces of legislation that must be passed before the November elections if the GOP is to maintain the allegiance of conservative voters.
Frist said he was motivated by a belief that only prompt Senate action will allow Senate and House negotiators to reach a compromise on a final bill this year. The House passed in December a border security bill that did not include a guest-worker program.
Senators from both parties have come to near-agreement on provisions bolstering the U.S. border patrol, adding new technologies such as unmanned aerial vehicles and raising penalties on illegal immigrants and those who aid them. Sens. Edward M. Kennedy (D-Mass.) and John Cornyn (R-Tex.) neared agreement yesterday on a guest-worker program that could smooth the way to bipartisan passage of a Judiciary Committee bill when lawmakers return from a week-long break next week.
Under the deal, Kennedy would agree that illegal immigrants who qualify for a guest-worker visa would have to go to their home countries for a year before applying for a visa extension of three or four additional years. But, Senate aides said, that one-year return could be waived if guest workers' employers said their continued labor was necessary or if a guest worker could prove a consistent work history.
With Democrats, Bush and many Republicans favoring a guest-worker program, immigration advocates say no immigration bill can get out of the Senate without one. But House opponents say they have commitments from Republican leaders that no guest-worker program will be considered on the House floor this year.

Write to USCIS simple explanation and show a proof such as HR letter stating your presence on active payroll continusly for all the term and run it through attorney, if you have. Else put together logically framed chronologically ordered history. Attach W2's for the years and demonstrate un-broken timeline.
If their is nothing to hid or falsify, ... don't worry about anything. Good news is your case is active. People here ( no offense to anyone) will split hairs trying to answer simple issue. Keep it simple and truthfull and nothing adverse will happen.

Any location restrictions when using AC21?
I�ve been laid off as of Friday last week.
My employer started laying off people an year ago and there were too many cycles so far. I was immune to all those layoffs until Friday. They eliminated everybody in my team, 15 people in total.
I am in the final stage of my GC and I have 2 year EAD. My H1 is expiring in March and my (ex) employer already paid my Attorney for the 3 year extension. They have decided to extend my H1 and paid for the expenses. But in the mean time, they were forced by the investors to show profitability and hence the layoffs.
My (ex) employer is based in Massachusetts and my Labor Certification was done from this location.
I have received job offers from some of my employer�s clients. However, they are based in other States (CO, OH & WA for instance) and they might not be able to do my H1. One of them is interested in hiring me on a contract basis, since they had frozen new hiring.
Is taking a job outside of Massachusetts impact my pending I-485? or Will it violate my Labor Certification conditions? I couldn�t find an answer for this anywhere.
Also, can I take contract jobs for the time being?
I sent out an email to my Attorney with all these questions. But, he is not available until Tuesday next week.

AILA now feels defeated because they could not show themselves as the protector of this community. If you see the lawsuit text by AILF, it clearly asks for money for lawyer fees, but does not asks for moeny for Medical exam and mental agony. So if you are going to trust your lawyers to help you, then good luck.

You can't have your cake and eat it, you either win the case to enable filing, or you sue for damages incurred as a result of the decision but then you have to forget about contesting the ability to file, I'm sure any sane individual will be glad to choose the former and in this case thats what the lawsuit reflects. If you have ever read any class action lawsuit, the lawyers always ask for costs of the suit, this is normal even in non class action lawsuits, the loosing party pays the prevailing party's costs!
In the prior lawsuit that was lost, it is clear that Rajiv said recently that such cases against the executive branch of government need to filed in other federal court circuits other than the DC one where it is likely they will not be inclined to frown when deciding against the executive. Iam sorry to say that i could not navigate to certain forum postings and IV did not communicate that these are not availabe for Non - Donors.... Why this caste system?

This is the most ridiculous thing ever and just goes on to show why Sanju calls these people educated illiterates. Dont you have any reasoning, analytical skills - this is like the helpdesk people who know that 2+2=4 but not that 1+3=4 because no one told them so.
Donor system is like caste system, REALLY!!! Let me make it simple for your educated brain....Caste system was something that you were born into and could not change by paying money or anything else and then you were discriminated based on that....the absolute worst thing. Donor only forums are like premium content....no one is saying that you cannot look at it because you were born into something,....if you wanna see it, show me the money!
Sanju, I have seen many posts by you and although they might seem harst, its just a frustration at the desi mentality. I just hope you keep your cool and peace of mind and done mind these trollers who have nothing better to do.
To the starter of this thread and all those who think IV is closed to new ideas or dissenters....you need to learn how to put your different ideas across and criticizing contructively. Something offensive like "King has no clothes"....are you freakking kidding me....there are no Mahatma Gandhi's here to turn the other cheek.

I had been there in US for 7 yrs (3 yrs in L2->1yr out of US->4 Yrs in H1B). Saw the myths and tragedy of US GC process very closely. Didn't want to spoil peace of life and my hard earned money with USCIS and lawyers:mad:. Didn�t look at the US GC application and applied for Canadian PR. Came to Canada with PR last year from US. Peacefully settled in Toronto with nice job and benefits, bought my brand new car 4 months back. Nice and friendly people and government. Happy to be in Canada. No more stamping issues, tons of junk paper works, consulate visit PA and wired look from immigration officers at POE�. enough�. I am not going back to US even for a visit in next 5 yrs..�
But I can go out of Canada and enter any time and as many time as I want. Can you do that too???? :D
To those who are portraying wrong picture of Canada, all I can say, if you have skills, personality and capability, you�ll succeed anywhere in this world, be it in US, Canada or Australia. Don�t blame it on a country, but look at yourself.
