I could not believe it either. My PD is August 2003 and EB3 from India. I have read many stories where people seem to have got GC when their PD is not current. In some cases, it appears they keep quiet about, but in some cases people seem to have corrected the situation to avoid any future complication, for example, if one decides to become U.S.Citizen at any point. It is just frustrating to think that I probably need to spend a lot of money on an attorney and go through the mental stress in resolving this because of probably an error some foolish clerk at USCIS made.

Here's what they got that we don't
1) Numbers - 12 million new voters indebted to them for life, is too hard for some national-level politicians to resist
- We are barely 1 million. Given we are "highly-skilled" most of us never likely to vote in elections (to avoid jury duties)
2) Strong support from US Citizens who vote for ethnic reasons. Whether anyone likes it or not legalization of "undocumented" has become a ethnic issue. More powerful than our international/global approach, because there are 25% of US population belong to that ethnicity ( and they also vote in greater percentages than the natives)
- Chinese/Indian/Phillipino/others USC/LPRs communities are miniscule in number. And most of them don't give a you-know-what.
3) They have the strongest Motivator - FEAR - it's a matter of 'survival' and not just pursuit of happiness like us. God forbid, we go back to our countries we won't starve there. These guys don't have any jobs in their countries and will be living in abject poverty . They risk death in the desert, whenever they go for vacation back home. Cops, criminals, USCIS, abusive Employers, Nativists - everyones at their back. Some of them are married to US citizens/LPRs. They face the prospects of getting separated from their families.
- We don't have such a strong motivation. If let's say there was a NumbersUSA sponsored bill to bring all legal immigration down to 50,000, believe me, DC would've been swamped by protesters. We may have met, even exceed initial projection of 10,000 participants. You'd have seen a true multi-ethnic protest respresented by every nation on the Atlas.
4) Money is not a problem for them. Many of them are paid off the books and have never paid Income Tax, SS Tax etc. There are also very strong political organizations, PACs (Political Action Committees) supporting. There are many USCs/LPRs contributing to election campaigns on their behalf.
- We pay all taxes. There is no PAC supporting the cause of EB immigrants exclusively ( ImmigrantsList is a PAC that supports all immigration including "undocumented").
Unless a LPR starts a PAC ( Aman?) starts collecting funds from other former-IV LPRs and US citizens and starts campaign contributions we continue to have a limited voice ( paying a Congressmans election campaign is will catch his/her attention more than paying a lobbyist to talk to them)
So it's not them having many negatives. It's us EB immigrants who face the strongest odds.
Just an analogy please dont think i am against undocumented fellows.. They are definitely facing a bigger problem than us!

Inspite of all these negatives , they have grouped up so well ! highly commendable. I dont know what we can learn from them, only that they are all in the same boat , but we are in different ones .. as some have got gc, some have got receipts, some are ready to wait as they have just applied, some are just not interested!!

What is the use of double masters and MBA from Harvard/Kellogs if you cannot get promoted. With all those degree on hand, you will still end up doing what you were doing at the time you filed for your labor.
Thinking about these options are good if and only you are sure that you will have your GC when you complete your studies. MBA is worst as it will have negative impact on your career if you continue to do what you were doing even after your MBA completion. Down the line when you get GC, you cannot substantiate your motive for MBA which is really going to HURT your carrer. MS is lot better then MBA.
If you are really interested in MBA, do prepare for GMAT / TOEFL , take the exams and keep your scores ready. Start doing some volunteer job / community work. Volunteer / non-profit work / community work will add some value to your resume to show your leadership skills.
DONT DO THE MISTAKE OF DOING MBA IF YOU ARE NOT SURE TO GET YOUR GC BY THE TIME YOU COMPLETE IT. IF YOU DONT GET IT, YOU SHOULD HAVE THE GUTS TO KICK THE US CAREER AND TO GO WHEREVER YOU RE EMBRACED FOR YOUR SKILLS/EDUCATION.
I agree. I realized that I was paying too much for my MBA from a top 15 school and I decided to put on hold for that exactly same reason. I received job offers from employers which were willing to pay 100% of the MBA. Of course I had to decline due to my status.
Also, interest rates in private loan banks are very high. I thought more about it and decided to put the damn MBA studies on hold and wait until I can change jobs and let an employer pay the thing for me.
My advice is for people to watch out carefully. MBA can get very expensive and you may just actually making your hosts happier, not necessarily you !

My advanced parole is good till October 2, 2009. I have been in and out US 2 times, spent 2 months abroad doing finals in college. Am going to intern abroad, until October 28th.
Q1: What is the best date to reenter the US and renew advanced parole? Do I need to be in the US to renew AP?

I was in Indian consulate for renewing the passport. I went there on time and there was a pathetic guy at the entrance who refuse to speak other than hindi. Though I told him that I do not understand hindi, he never listen to that and started his conversation with hindi.
Then comes the worst part. A cab driver went to him and handed over some dollar note and got the token. Then the driver handed over the token to the passenger and left. That guy got into the line well before me and got his work done. @#$K those people.

There was a Telecon held yesterday night ( 9:00 pm - 10:30 pm) on establishment of news state chapters. Some core members as well as some veteran State Chapter leaders participated along with us greenhorns (newbies). Me, Chintu25 and CagedCactus participated from Michigan. Regretfully since it was a last moment decision , more members couldn't be invited to participate.
I was active in the Telecon almost to the last (I hope). It was a highly educative and informational to listen to the IV Core perspective on State Chapters. Veterans also pitched in with their experience in organizing their chapters (some super secret recipes were revealed :)). Some chapter leaders for new chapters also introduced some great ideas. To the end, I started bombarding the core with lots of questions, and they were patient in answering all of those ( b/n 10-10:30 pm!).
Unfortunately these matters cannot be discussed in the public forum here as we are monitored by Anti-Immigrants. Ditto for E-mails and PMs as we have no way of verifying the authenticity of the other person. So please don't feel offended if your PMs and E-mail inquiries remain unanswered!
ONLY way to get acquainted with the 'inside news' is to participate in the 10/20 meeting, details of which are published below. Be there if you wish to remain in the know.

My I-140 is approved and already filed I-485. Finger Printing completed twice and Medical also completed. My PD is Sept 2005 filed at Texas. Texas Processing completed for I-485 shows Sept.2006. This means my processing is completed and now the PD is current can I expect the Green Cards ....

Yes that is true. They are lobbying strongly for H1b though they are supporting GC increases. Actually with H1b you can stay unlimited years if you apply gc. So there is no urgency for corporations to resolve the issue. They do not have fear of losing you as you are going to stay in USA until you get green card
I don't think the tech companies are lobbying (strongly enough, if at all) for EB GCs. They are happy as long as H1 quota is increased which I think they will get in one form or the other.

To add to this.. Some will think that something good just going to happen since next year is election.. Not sure what makes them think that..
Some are extremely negative-- They will say doesn't matter what you guys do,nothing will happen.
Those with negative opinions - they do not do much in life too - most of these wake up late in morning, go to work, watch TV , lazy in weekends , play cards, chat on phone , always spend a lot of hours on the internet researching for some crappy deals on electronic goods - the time, if well spent is worth more than what they save on buying the item.
Though it is difficult to change their attitude - it is possible, we must be persistent in our effort.

This question is not to undermine the effort, which was tremendous but just from a realistic point of view...
I'm just curious to know how long it will take for the impact of this rally to be felt and what are the changes that can be expected from USCIS as a result and how long will it take?
Say, after waiting for a few months, status quo continues, what further actions are planned to persist with IV's cause (i.e. more rallies or by other means) ?

My case with PD of Aug 2002( EB3) was stuck at PBEC until May 23, 2007. PBEC had closed my case multiple times, and had to really fight to get it reopen and finally certified. I have sent emails to Sec. of Labor ( Elaine Chao) twice. Her office was helpful in opening my case. I got reply from her office within a month too. Also, I mailed senators too. Try to talk to senators from your states. I know and understand the pain of you guys, whose cases are stuck at BECs. Personally, I feel that you guys should mail Sec. of Labor, and let her have the attention of these cases. This is really injustice!

And the worst thing is they approve it from the date tey approve it to 1 year after..My EAD which was expiring on 2th Sep'2008 was approved until Jun 20th 2009. Basically I got a 9 months extension...What a plan...

I called the office and also got my better half to call. BTW I was locked out of the forum for a couple of weeks when after loggin in it was directing me to update my information. which I promptly did but it seems all the fields have meen made mandatory so it kept of directime me to put other information like when I applied for my I 485 which I haven't but I had to eventually put some garbage data. can some one look into this, I am sure there are a lot of other IV members being blocked out.

I would expect a minimal level of service from an expensive lawyer whether my company or my wife's company or I myself pay for it. We are their client. That is what they do not understand.
Can you believe they took 10 days to inform us what docs we need to provide for the 485 filing even after the fact that we had called them the day in June when the priority dates became current. Even in the list of documents, they had "Certified Birth Certificate" and when we asked how do we get Certified, they were like oh just give a photocopy. We had already spent 3 days researching about this CERTIFIED BIRTH CERT. The certified concept is something which is not common in India but it is in USA and a company like Fragomen should know this - it is their job.
Even after HR's multiple emails approving to start the filing 15 days later they ask us if HR has approved this - RIDICULOUS.
We asked them for the copies of the filed petition, they took 1 month to provide them as they were TOO busy filing other applicants - fine but making copies and sending over should not take more than 20 mins.

All I expect is when we are paying so much money - they should provide services to us.
