Hi,
Here is our situation. I am on H1 and have 485 pending for me and my wife. Both of us also have a valid EAD.
My wife was on H1 too, however since Oct'08 she relinquished her H1 status and took up another job using her EAD. Currently, we are planning to have her AP filed (her earlier AP expired in Dec'08).
Given all this, I have following questions.
a). Are there any risks associated with filing AP.
b). I presume her status has been valid so far... reason I ask is that we didn't do anything special in terms of communicating any official agency, when she jumped the boat from H1 to EAD. Were we supposed to?
c). Do you think I can get her on H4 while she continues to work using her EAD. I guess H4 option is more expensive? Any thoughts?

We need to draft a letter specifying the chairman.

Can some suggest me what my wife (on valid H1B visa and AP) and daughter (us citizen) need to carry along with them. I am just curious to know if there is any change in documents required to carry with them. As of now, I am expecting them to carry their passports, PIO (daughter) and AP (for my wife) along with them. Do you suggest any thing more? Thanks in advange for all your suggestions.
If your wife's H1B is valid (unexpired), she is fine. If not, she need to take a flight which does not stop in (most) European countries which require Transit Visa.
If your wife is maintaining H1 status she can enter on H1, if she is using EAD, she need to enter using AP.

YES Baby!. I am making it to the Sep 18th DC Rally. I am also bringing my parents (who are visiting US) along with me to the rally. So, total count is 3.
Initially, I was planning to take them to just NYC. Now I changed plans and decided to show them DC as well. Since we are talking about Washington Monument and Capitol Building, I don't think they will mind at all :).

Agree with you 100%. Instead of 'forming' state chapters in the last moment, they need to be established, nourished, strengthened and developed over a period of time. A grassroots movement needs strong roots in all regions.
With all due respect, it was a disaster. They ended up scaring Americans - by holding Flags of thier countries, holding US flag upside-down or disrespecting US flag in other ways. This provided fodder to anti-immigrants to scare Americans of an 'invasion' of law-breaking aliens.

Do you really think the numbers will be that bad? Look at the improvement in turnout in DC from San Jose? Every movement political or not builds gradually. The idea is to make it easy for people to show up rather than ridicule them for not showing up.
We asked people to show up at the rally giving up (1) A day�s pay ($400 to 1000) (2) Spend money on travel where ever the buses were not available ($$) (3) Spend time away from home. That�s a little difficult for people who have not seen a single person from IV yet (which is most of us). On the other hand many people who attended the rally in San Jose did not mind traveling all the way to DC�Can you think why? Do you think Indian�s in CA have a different mindset compared to those in TX or NY/NJ?
IMHO, we need to do more work at grass root level. If rallies are local and on a weekend then more people will turn out. Not only will there be better turnout, many of these same people will being more passionate about their support to IV and might start showing up in out of state rallies and protests.
Many of my colleagues did not even know until yesterday when I showed then the news articles that there was a rally like this in DC. Unless we have local chapters with an organized structure which meet regularly/ even if it�s a conference call, you cannot expect mass mobilization�this is Politics works!!
I think the DC rally has caught every ones attention, this is the right time to push the drive for local mobilization, it will be tragic if we lose the momentum now.

As per member priderock's post the LAY ON THE TABLE description from THOMAS means that the Cantwell AMDT has been killed .

One amendment that has been “filed,” but is not currently “pending” is the Cantwell amendment which is very important to business immigration interests. We do not know at this time what will happen with this amendment – whether it will come to the floor for debate or be negotiated through unanimous consent into the final package.
From AILA's description it would seem that the Amendment is does not have the status "lie on the table" as that would mean that the amendment has been killed with no possibility of coming up but AILA's description as to possible future of the amendment is to the contrary.

We should focus on spreading awareness about IV. I can't believe I was totally unaware of IV's existence until a month back. I haven't done much but felt strongly about what IV's doing. Me and my wife attended the rally and even contributed for the first time ever. We should brainstorm on how we can get more people on board and on how to transform members into contributors.

Looks like USCIS is sending more denial letters on AC21 cases these days, a lot of VOs may not have been trained on AC21.
I took infopass this week to find out status of my case (AC21 responded to NOID and case reopened and lot of soft LUDs) - the VO was trying to be judgemental instead of looking at computer and answer my question. She said "If you change job and 140 is revoked, there is no way your 485 will get approved" and when I insisted her to look at computer and let me know status, after some nagging, she looked and told me case is pending and NC cleared and I will receive a decision sometime but not very soon.
Believe me, a lot of VOs do not know AC21 stuff.
Let me wait for actual denial letter.

And the worst thing is they approve it from the date tey approve it to 1 year after..My EAD which was expiring on 2th Sep'2008 was approved until Jun 20th 2009. Basically I got a 9 months extension...What a plan...

My wife had a H1B working for company A from 08/2003 to 07/2005 (from I-94) and she filed another H1B application to work for company B in 05/2004. She got the notice, stopped working for company A and started working for company B. However, she never got the aprroval notice for the second H1B application. Actually this case is currently still pending. She worked for company B until 07/2005 which is the expiration date of the first H1B. She changed to F2 later in 07/2005. I was wondering if there is any problem about status or employment authorization for this period of time from 08/2003 to 07/2005.

During FY due to anticipated heavy demand, the AC21 provisions are not expected to apply ...] This will mean an Employment per-country limit for FY-2006 of approximately 10,650.
To illustrate the effect of the reduced per-county limitation during FY-2006 on the oversubscribed countries, it should be noted that during FY-2005 India used approximately 47,175 Employment numbers.

Maybe I'm misreading above statement, but it sounds to me that because of higher demand (of ROW), AC21 wouldn't apply anymore, and instead of 47k in '05, India had only received 10k in '06.
Note that I think the immigration system is broken and needs to be fixed. By changing their interpretation, they are only taking away visas from one group and give it to another group. I can certainly see why people who are affected by this would be biased. No harm intended.

People talk here about filing lawsuit as it it is easy as filing something and on first hearing, judgment will be passed in their favor. Of course, no one even bothers to get initial professional advice.
Soon, we will have some other topic that will have similar discussion and similar fate.
