Applied for Non RIR labor during April 2004 under EB2 in Ohio. Employer changed address (in same city) and one year before. Last week I came to know that Dallas BEC closed my labor case since they didnot recd the 45 day letter response from my employer. My employer requested Dallas BEC (with proof of informing them the address change) last week to re-open my labor case to continue processing the labor approval. My employer says it's better to apply for a new PERM as a backup.
Can the IV members advise me how to proceed on this?

(1) I have applied my Labor Certification in February 2003 and It is approved in September 20, 2007. After almost 4 years. Now, my employer is ready to file I-140 by October 10, 2007. I am also in my 7th year of H1-B visa and it is expiring in August 24, 2008. I have heard that you need to have 365 days of time period between Labor Approval and H1-B renewal of VISA for 8th year. If my I-140 is still in pending stage until August 2008, still Will I be able to get my H1-B extension for 8th year? In reality, I am short of 60 days to finish the count of 365 days.
(2) On the other side, I may not have worry as my Labor was filed in year 2003.
Any Clarifications?

You must have at least two years of post-baccalaureate experience in a high-tech field to be eligible for an H1-b visa, or else have a masters or higher degree. So where did you get your experience? Are you still back in your own country? Working? Or did you just get your bachelor's in the US and are still in the US,

It may be time for a day of research. I'll be doing something similar in the near future, and my plan is to sit down with a cup of coffee, the yellow pages, and my phone and call the photographers in my area and ask them each that same question. I'll make a chart and put names to prices.
Where you have an advantage over me is that your town's population is about 32,000 whereas I'll have to do this over the entire metro area where I live. Ughh!
