My labor and 140 are approved. 485 is pending.
Can I go to India and come back , say just 5 months before my PD comes current.
e.g. the EB2 is now hanging at March 05 . My PD is at Oct 05. When it comes to around Aug 05 ...I will come back and start working.
I have to fight some litigation there .I have my AP Documents and EAD all right .
my Q is WILL THIS CAUSE RED FLAGS ON MY 485 APPLICATION. As long as I was in US I was employed. But I was out of US for my own personal situation.
Please advise

Every day, a small Texas company compiles the reports and sells them to lobbyists, lawyers and others who pay thousands of dollars for a peek at the reports and what they say about the congressional agenda. And it's all legal.
"How I get them is my trade secret . . . but I get them all," said Walt Seager, who digs up the reports for Gallery Watch, a legislative tracking service.
The Congressional Research Service (CRS) was established in 1914 as Congress's supplier of nonpartisan research and analysis. Its reports are neither classified nor copyrighted, but they've long been the exclusive property of lawmakers, who distribute them as they see fit. Taxpayers supply the agency's $100 million annual budget, inspiring open-government groups and some lawmakers, including Sens. John McCain (R-Ariz.) and Patrick J. Leahy (D-Vt.) to push for public release of CRS reports.
Aftergood and others have fought back by posting every CRS report they can find on their Web sites. But watchdog groups have released only about 10 percent of the total, not enough to reveal the patterns that suggest what Congress might do next.
Subscribers to Gallery Watch pay about $4,000 a year to get all the CRS reports, online and searchable, delivered weekly.
At a recent meeting for potential customers, Riendeau explained that clients scan the reports for intelligence "kind of how the CIA operates," by spotting the political trends suggested by their contents and timing, he said. My wife is going for h1b stamping in Chennai on Jan 17th. She converted from H4 to H1 and and is doing her first year residency in a community hospital in New York. We have all required documentation. Letter from Hosp, 797, 129, LCA, offer letter, ECFMG certification, USMLE transcripts, degree, school transcripts.
In addition, I am asking her to take utility bills and bank certificates and paystubs.
As she was in h4 for 2 years, would the VO be asking her for my stuff like, my w2s, my paystubs etc????
Has anyone gone through this? Any specific questions related to residency? Does she need to take information about the hospital like brochures, etc.... does a visa interview for a Physician focus on the hospital and its operations????

We like to share that the H1B cap is extremely close to being reached. The count as of December 15, 2009 is 64,200. This is 1300 cases more than the count from December 11th. This count is very close to the total cap of 65,000 which is actually somewhat reduced by numbers allocated under trade agreements. We continue to watch this very closely, and will provide updates until the FY 2010 cap is reached.
We suggest to act quickly to avoid last minute embarrassment as H-1B Cap may soon be cease to exist.

I think once the I-140 application is filed based on the state of residence, USCIS can transfer it to any service center. The applicant doesnt have any control over it. As far as I know, the applicant cannot request for a change in service center.

Labor, I140 approved and I-485 filed during July-07. Have EAD and AP but never used it. Still on H1B, extended for 3 years based on approved I140 and valid until Dec 2011. With my GC employer all along, employer is applying for LCA now as my new client is located in different state. My questions are:
� Whether there will be any impact on my ongoing GC process if the job description on this new LCA is different?
� If anything goes wrong with this LCA, whether there will be any impact on my existing H1 and eventually on GC process?
� If something wrong happens to my H1, can I still switch to EAD after that?
� What is the process to move from H1B to EAD within the same company, is filing new I-9 with EAD detail is suffice?

Now a days VFS is not releasing appointment dates more than 2 - 2.5 weeks in advance. I am not aware of any specific time of the day when these become available.

No. You can't port PD from spouse.
You can port your own PD, if you have another EB3 approved.
You can port the country of chargeability, if she was born in another (ROW) country.
My priority date is in 10/2006 under EB3. My wife just start her GC process under EB2. Can my wife port my PD date to her GC application?

USCIS is reporting that as of November 6th, 54,900 H-1Bs had been issued against the 65,000 annual quota. While this represents a dramatic drop in H-1B applications over previous years. In 2007, nearly 200,000 applications were filed in the first week applications were open and in 2009, the application period is now in its seventh month. Usage seems to be about 1,000 cases a week so we're probably looking at January or February to run out of numbers. Incidentally, yesterday I was the moderator of a panel on the impact of the global recession on national migration policies in Amsterdam....

In years past, many remember that the H-1B quota was exhausted as early as the first day of applications. Last year, the H-1B cap was not reached until January the following year. I would anticipate that with the economy still rebounding, the H-1B quota will last a significant amount of time. This will also ensure that everyone who can find a job offer this year will have a chance to make an H-1B application. No, you only pay the visa application fees. India has a visa agreement with US so issuance fee is no longer required. You should check the US consulate website for more details.

Employer B wishes to recruit me by transfer H1-B and utilize recapture time. The total time they would get is till Apr 2010 (which includes recpature time) along with 7th year I-797.
Employer B wishes to file LC 1 month after I join them.
Assuming that I join them by end of Dec 2008, I have the following questions about my H1-B extension
Lets consider Dec 30th as the date to start the LC application.
What I understand is that based on the LC from Employer B,
Can I get extension on my H1-B beyond APR 2010.
for 1 yr - Based on LC from employer B being pending/approved until Apr 2010
