The USCIS announced today, April 27, 2009, that it has received approxiamtely 45,000 H-1B petitions counting toward this fiscal year's general cap of 65,000. Therefore it will continue to accept H-1B petitions that are subject to the general cap.
Then USCIS also announced that it has received approximately 20,000 H-1B petitions for aliens with U.S. advanced degrees subject to the 20,000 advanced degree cap. However, the USCIS says it will continue to accept additional advanced degree petitions because it knows from past experience that some number of the advance degree petitions are not approvable for any number of possible reasons.
I will update this blog on the H-1B account as soon as the USCIS makes further announcements.

Hi Gurus,
I tried checking my I-485 status over phone. I called after hours. So it went to the automated message. Thought just to listen what the message says. It was something interesting. Thought to share with you. Do any of you have the same or similar experience?
07/02/2007 - Application Receipt Date in I-485 notice.
09/04/2007 - Application Notice Date in I-485 receipt.
08/01/2007 - Application Receipt date according to the Phone Status(Automated).:confused:

kinda... a little more abstract then what I think people would normally think of as a warp effect... but then again I dunno what else you'd call it!:P Either way it looks good... call it what you like!

Hi,
I switched from H1 to EAD with the same employer. Due to family emergency i got to leave and may have to stay for more than 2+ months.
Would that be ok if i stay out of country while on EAD. I will be returning back using my AP.

I am in little trouble.please help.
I will be graduating in May'07. I am not eligible for OPT. I have a job offer and the company will be applying for my H1 in April. But I cannot start working before October.
1.Is there any way I can start working in May?
2. what options do I have to stay legally in US from May-Oct?

Yesterday I received email that card production ordered and today it says I have to go through some ADIT processing. Does this mean that they require some additional documents for processing or verification. The exact message is as below...
"On August 6, 2010, we mailed you a notice that we had registered this customer's new permanent resident status. Please follow any instructions on the notice. Your new permanent resident card should be mailed within 60 days following this registration or after you complete any ADIT processing referred to in the welcome notice, whichever is later. If you move before receiving your card, please call our customer service center at 1-800-375-5283.
During this step the formal decision (approved/denied) is written and the decision notice is mailed and/or emailed to the applicant/petitioner. You can use our current processing time to gauge when you can expect to receive a final decision.
"
Can anyone please tell me what this means.

Hi,
My labor was denied first time through PERM(December 2005) and later after refiling, it got approve through PERM ( Applied on May 2006)
Now Can I use my first labor filing date as the priority date(Decmber 2005) or they will take the new date(May 2006).
I have I-140 Approved.

If my priority date is current based on March visa bulletin, till what date can I file for my 485? Do I have time until end of April?
You can file anytime after your dates are current.. Just don't take too long though, Remember if the dates retrogress again, then might get out of luck! Again!! So file it right away if you can...

Hi,
I am on EB2+PERM. I got LC approved and currently filed for I-140 and 485.
As I understand unless the I-485 is pending for more than 180 days after the approval of I-140, I have to restart the whole process again with the new employer (expect that I can port PD if I want to).
Now are there any chance that if the above scenario happens, and my employer did not revoke I-140 or 485, that I can still receive my GC? Or that will be illegal? Please clarify.

Talk to an attorney he should be able to kiss your employer's ass with lot of things.
If your employer is paying more than what is mentioned in H1B, then you cannot do anything.
If you are working on % basis, then forget about 14k if till you work for him, prorate of H1B pay is paid.

Hello
My friend is in USA on F1 visa and her wife and daughter denined visa twice with reason that my friend is studying here not working.
Even he is not offering sponsership to her wife and kids. His in laws are sponsering both of them. Now he wants to invite them on his graduation day. Can he get a letter from local senator with F1 visa status ? or is that only for people who pays taxes . ( H1b or l1b ) ?
Please advise.

AP is for reentering US
Pending 485 is status in US
So, if she is not planning to work - then no need to apply for EAD

Dear All,
Today i read that their is a new law prohibiting the employers from filling multiple applications for the same employee.
I have applied with 2 companies,as an employee , i have two different employers, who will file application for me.
Is it against the current law or ?
Pls help me asap , so that i can stop atleast one of the employer , if needed to file the application.
