    I think there is more smartness needed than luck in the greencard process. If you look at the posts in this thread there are some people that came to USA in 1990s and still waiting, while some that came much later are on their way to citizenship. Some got the EB2 route and are happy and some in EB3 have only gloom before them.

    This in my opinion has helped smart folks among us:

    - They applied for GC as soon as possible. Those who waited did not give importance to Greencard as soon as they started a job in USA are now paying for their mistakes. During the initial days of career I have seen people saying that GC is not important to them etc but when their H1B is about to expire they panic and get desperate for Green Card.

    - Before pre-PERM era in 2005, smart folks took up jobs in states where labor certification had no backlog. They are now either waiting for citizenship or already citizens. On the other hand people in states like CA, NY etc suffered due to labor backlogs and far from getting greencard in hand.

    - Any company can be good or bad for an individual. It it not a question of consulting vs fortune 500 or small vs big size of a company. Smart folks know what matters them the most when they join a company. When company sees them as a valuable asset, it applies for them. I have seen where company applied for GC as soon as the employee joined it. And I have seen posts where people had to wait for several years before company applied.

    - People who took advantage of the Labor substitution got faster labors. Some could take advantage of EB2 labors and they are very fortunate. This is in no way endorsing the labor substitution rule, but in pre 2007 times nobody was protesting against it. This is a sad reality.

    - Smart folks took the risk and changed jobs wth EB2 job requirements, so that they can file in EB2. Such folks with 2007 PD are happy today and people with 2003 PDs in EB3 will have to wait for a long time.

    - If you read posts on this thread, many people have posted that they feel they are being screwed by their employer or lawyer. But hardly anyone has said they took any action against it. This is also a sad reality where we as a community have failed and will continue to suffer.

    - Many folks have said that they thought they were in EB2. But found they are in EB3. This shows another weakness of our community and lack of awareness. IV forum tries to spread the awareness but unless an individual takes initiative, they will suffer.

    Many people were able to file I485 in July 2007 due to IV effort. Imagine a 2004 EB3 India person without EAD today? How will he survive a job loss on H1B in a bad economy? We should take a lesson from that event and try for another big push. There is no other shortcut for us. It is shocking to find people on this thread that are in this country for more than 10 years and without a green card. These folks should be the most vocal folks in this effort.

    Pappu excellent post full of true facts. Being smart in my opinion means being knowledgeable and aware of the current situation at any given point of time rather than being ignorant and indifferent. Most of the time doing some basic research can lead an individual to the right option that is legally consistent and correct, it’s really never too late to correct course. Yes there will be street smart people (Sub labor being one example) who will game the system but besides other things let’s accept that they know how things work. Life is about learning and then What Next? It’s really about continuous improvement and trying to move in the right direction. Not having the desired end result is fine but not doing anything or not trying is bad. Very nice and motivating stories from some of the veteran’s you give us the motivation to hang on. OP you seem to have started a nice discussion.

    It certainly is a bad news..
    guys my PD is april 2004, does that mean I stand no chance. I had RFE on 08/14.Should I still keep hopes till the end of the month, or its all over for me till my date gets current again...Senior members plsssssssss respond...

    SO IF they move PD's to 2006 dec then there is aposibility that all 2006 pd 's get GC's before 2001 pd's.:mad:

    hope you guys have visited the IV physicians blogspot.It is very good.One of the bloggers mentioned about supporting such a move, but the question is how do we start.I myself is technlogically challenged so we have to get the expertise of the IT people.I think we should start now.

    Its been close to 2-3 weeks since Ombudsman's office got to know about this issue. Inspite of them contacting TSC they still do not have a response yet. So now its time to send Ombudsman's office with completed Form 7001 so that they get to investigate your individual case and assist you. They are obligated by law to investigate and respond to your request. The more people send out those forms, the more important it becomes for them to address this issue on a priority basis. So please take the time to mail out the forms soon.

    The employer can establish an account for an attorney or other agent at http://www.plc.doleta.gov. It's unique PERM cases filed by that employer.


    hmm maybe they should hire some Indians to do there software design ... :-) jk :p

    Here is how I came up with that analysis. Last year they made changes to give GC for those stuck in FBI name check if they passed 180 days. So most of the ROW got their GC last year. There were not many labors approved from 2008. So there is no demand from EB2 ROW this year. With the economy going down, not many would get EB1s either. I don't anticipate many EB5s either this year. So major chunk of EB visas will need to come to EB2I/C. Will CIS do that or not is a different story.

    This is only for EB 2 aliens of exceptional ability. As far as I know this does not need perm. I got an EB2 alien of exceptional ability when my last employer filed through Schedule A. So don't sweat this does not apply to the usual EB-2 route...as far as I can tell...

    Listened to the recording. I simply cannot believe what the host was babbling again and again about. He was repeatedly asking Jay “Why should the laws be changes which were set 50 years ago?” I will tell him why the laws are normally changed in general (not related to our case at all). They are changed because by definition law is supposed to be just; it is supposed to be equal. It is required to be non-discriminating. It is changed because people’s life is affected adversely if it remains constant. Laws of nature are the only set on laws that cannot change and that is true because they took billions and billions of years to perfect themselves. Laws of any country on this earth are not perfect. They are made by human beings, who tend to make lot of mistakes. Now, what is amendment? It is a set of new rules that are written to rectify any mistakes made in the existing laws. That itself is changing the law, my friend Raj. There is no county on this earth whose laws have remained the same for a very long period of time, and yet keeping all the people in that country happy. Laws get changed because of the new values added to the system. That is why, my friend Raj, slavery was abolished in 1863 by President Lincoln (BTW my most favorite President). This did not happen by magic. It happened only when the president issued an Emancipation Proclamation, which basically is a law and the jist of that is , "all persons held as slaves henceforward shall be free”. Now how did this happen? Because of the civil war and why did the civil war took place? Simply because people cannot take it anymore. You should know all this Mr. Raj Khanna, you were there to witness it with your own eyes when you were 147 years old (well at least that’s what you claim through your profile).

    PS I did not listen to the antakshri, but if some of us did listen, we need to provide the curious lady with the correct answer, maybe her GC case is also pending for the last 7 years (probably a future member of IV).

    I worked for a MNC here in first few yrs at US (from 2000) and they suck up your Tax return , used to give a worthless health insurance and 'sweat shop' ( this probably a worse word than 'chop shop') like allowance for 12-14 hrs of work . If you do NOT accept that or ASK QUESTION your flight tickets back to origin to will be arranged. I know these practices changed to some extent over a period of time but by that time I left them and started doing things on my own ... :) and i'm very happy since then.

    Another thing , I worked for good but medium sized consulting firms with US after leaving those shops ( sweat/chop/body whatever kind u call them) and they do maintain perfect balance - hardly 30-40% is H1B - they pay market salary to the H1B's ,standard health insurance , always got paid if i worked beyond 8-9 hrs ...

    Lot of folks are like me within the community ...

    Not true. Whatever they can outsource, its already gone. There are certain position where the clients demand onsite resource. I am not supporting this bill in anyway, I hate infy as much as I hate this bill. Remember these companies did not leave any stone unturned, milked the client every possible way and expoilted the employees to the maximum extent. In one another post - VLDRao was saying these companies does the tax filing on behalf the emoloyee, get the refund and again claim that tax in india using double taxation aoivdance treaty.

    I thought I will share my experience with all members who are facing processing delay for their I-140. My I-140 was filed at NSC on March 21, 2007 and got transferred to TSC on May 21, 2008. Since then, I see no activities (I believe TSC was treating transfer date as receipt date and they didn’t bother to look at my case). On July 29, 2008, I asked my Lawyer to initiate the inquiry about the delay and his paralegal took the “service center request” from USCIS for my I-140 and service center issued a confirmation number (ETCXXXXXXXXXXXXX) for further inquiry.

    Within 10 days of initiating the inquiry, my case was approved on August 9, 2008. Please do so if you think it will help.

    I have got a PM from another IV member whose 485 got denied yesterday because of 140 revocation. He switched the job after 180 days and sent AC21 docs as well. He is willing to share his ordeal with us.

    Are we sending personal exp of the ppl affected along with the letter ? I guess, it makes perfect sense to send some real 485 denial examples.
