Hi,
I got RFE on Advance Parole requesting proof that I have complied with NSEERS.
All I know is I went for Special Registeration back in 2003 when it initially started and citizens of specific countries were required to go for that special registeration. The immigration officer stamped my I-94 and wrote a FIN# on my passport and I-94.
Last time I travelled out of US was back in May 2001 for couple of weeks.
Now got this RFE any idea what do I need to submit.

She come her on H4, because her husband is here. She can come here again on H4, if H1 is denied. Why she is staying in India, if her family is here ?
What is the reason for denial ?.
If it is because of education, chances are less to get approval again.
Otherwise try another company.

My h1-b is expiring in decemeber, i applied for renewal 4 months back but it is stuck in security check. I can apply for 485 as my 140 is approved.
1. if i apply for 485, then EAD can also go thur sec check?
2. after 240 days if EAD is not available what are my options?
3. I am planing to get married but cant bring wife on h4 as my h1 is not current, what are my options? if my 485 get approved or i use my EAD i wouldnt be able to bring her?

Per old instructions everyone was sending to Nebraska, and new instructions published are for 'direct filing'.
Do I follow direct filing rule or Nebraska only rule?
I am finally ready with medicals and photos and will be sending packet tomorrow.

Here is my situation, my PD is March 05 and my 140 is pending for the past 3 months. Do you guys think if I get my 140 approved by Premium processing it would increase my chances of 485 approval this fiscal year? BTW, as its obvious from my PD I will be filing my 485 in July, God willing.

My employer has been holding back my wages on some excuse or the other. Since I was awaiting my GC, I had no choice but co-operated with them. I got my GC last year in July 2010. I worked with them until September 2010 and due to this payment situation, I have chosen to work elsewhere.Now they promise to pay the back wages from 2010 but the payment never arrives. Repeated followups, emails and calls have yielded the same result. I am not sure what are my options here at this point. I no longer work for that Employer since they never pay on time.

I mean does it make any difference far as 485/EAD if the employer does appeal or MTR?

Please share your experience. This is quite urgent. My H1B(8+ year) is expiring, and my company is willing to file H1B with Engg manager role. My previous H1B or extension was files for software engineer. My GC(EB2) is filed as Software engineer, with PD as Jan 2006.
Questions
1) Now is it ok to file H1B with new title? What if H1B gets rejected?
2) How does this title change affect GC? Can the GC be cancelled because the title has changed or H1B gets rejected? The engg manager role is similar to software engneer role, except people responsiblities.
3) If the H1B gets accepted, then is there still a danger to GC? Do they verify GC papers before approving H1B?

B-1 business visitor may be admitted for the purpose of enaging in business but not for the purpose of local employment or labor for hire. in distinguishing, the determination would be whether the principal place of business and actual accrual of profits are in the foreign country. I am US citizen since March 2009. Husband just received an interview notice for August 11 after having filed all required documents and application for I-485 adjustmnent of status. Along with other documents, we submitted a xerox copy of his I-94 which he overstayed. Unfortunately, he lost the original. My concern is, the interview notice states he is to bring the original I-94, which he no longer has. He can prove however the date of his last entry to the US, as he still has a stamp in his passport with admission date, a sticker on his passport cover for baggage and I can probably dig up his boarding pass. Again - we also made a xerox copy of both sides of I-94 when we still had it. What do I do? Should I get a duplicate? Or is the xerox enough for the interview? I would hate his application to be denied because of this. Please let me know if you had a similar experience or any advice on what I should do.

I am not able to figure out if this new Merit Based System (if implemented is good or bad for us)
If the guys who already have made some progress using the existing system are asked to re-apply under this new merit based system, it is going to be bad for them, because they have to go through the entire process again.
What about people like me, who are new commers to US ?
If I apply under the new merit based systems, am I automatically subjected to backlog, because people who applied for GC under the previous system have not yet gotten their GCs, or this new merit based system will have its own quote ?
Can anyone explain ?
