Hi everyone,
I need a suggestion . i am working on virgina state. and my employer is running the pay roll on newjersey state. I am sending emails to him but replying. I am working on from last year for that company. He is having backup amount (caustion deposit) nearly 7000$
Please help me what kind of legal action i can take ?

all documents/info mailed to NVC
NVC got my documents for 1 month
I am considering to email the NVC to check on the status of my case.
Should I email the NVC to check now (after waiting for 1 month) or wait another month (hence I would have waited 2 months) to check with the NVC on my status?

The couple applied for the green card together. The husband applied under the EB1 category and his wife also applied with him as dependent. The green card of the couple has been approved and is expected to arrive in a month's time. The wife is not in US currently. She is outside US. Will the husband get his green card & the wife's green card in his wife's absence? Will there be any complications in the husband's green card in this case?

My daughter (5 yrs) is an US citizen and having passport valid until end of Sep 2009 and having POI card for 15 years from Indian consulate.
Now I am planning to take her to India for 3 weeks from Aug 1st week. The travel agents says her passport should have at least 6 months valid from the date of date of the return (Aug 4th week). Is that true/correct? Can she enter here in USA after her India visit with 20 days left in the passport validity?
I will be using my AP though I maintain H1B status (I-797) and work for the same employer.

LCA for people who work from home
I work from home and one week a month i go to my consulting company office
I live in Texas and company is in NJ .
my question is should the lca be filed from nj where the company is
or should it be filed from Tx where I live and work from home

My wife is currently on H4 and we have EAD/AP, though not used. She is planning to apply for H1 with new employer.
When approved, does she need to leave the country and get visa stamped before starting employment.
If she leaves the country and enters using the AP document, will it cause any issues with her H1. Any input will be appreciated. Thank you.

Friends,
I need a clarification on EAD card usage. If your spouse whio has an independent H1B visa and whose 485 and EAD application is dependent on you, changes the work status from H1B to EAD, then does the status of the primary applicant also change to EAD automatically. Since the spouse's application was not independent filed and was a dependent on the original applicant for both 485 and EAD applications. I want make sure that the primary applicant's status ( separate independent H1B ) is not changed from H1B to EAD, just because of the spouse starting to use the EAD ( who is a dependent filer on primary applicant for both AOS and EAD ). Would appreciate your inputs.

hi,
I am unmarried son of citizens of usa and have my priority date current.I filed for I485 adjustment of status to permanent resident, which earlier got rejected,but then on refiling,I got a MSC receipt number saying next process is biometrics
My question is that as I am presently on student visa and my classes are starting from august 17th.Do I still need to maintain my student visa status and enroll in 12 minimum units,or is it ok If I don't enroll and just wait for my further case processing,and I won't be considered out of status as my I-485 adjustment of status is being processed?Is there still chance of my I-485 being denied(I don't have any criminal or any wrong record and maintained my status prior to filing my I-485 adjustment of status).Please guide whether to still enroll in 12 units and be on student visa or is it ok if I don't enroll as I no more want to pay high fees but,am worried about maintaining my status.

We filed our 485 on July 2nd 2007 at Nebraska office � EB3 � July 7, 2001
- The case was shifted to Texas and we received notices from Texas office with receipt date of August 27.
- Our date is now current however processing at Texas is still stuck at June 27, 2007.
- Does this mean our RD is now 08/27/07 even though it was recd. at Nebraska on 07/02/07??
