Please share your experience of H1b visa stamping in Halifax or Quebec (Canada).
I am planning drive to Halifax or Quebec end of this month.
I am intended to use �AUTO VISA Revalidation� rule.
I am from India and I don�t have any U.S. degree.

Hi,
I am transfering my H1b to my friends company. And I have to bear all fees. As such my case is simple, no complications. I have good education credentials and 10+ years of exp. Got education evaluation also with me.
I just went thru USCIS site and it looks like to me that filing H1 transfer by myself (or by my friend) is a fair simple job.
Can anybody give me advice or have some experiece in filing H1 or transfer H1?

On 10/01/09, President Obama signed a continuing resolution to fund continued federal government operations through October 31, 2009. Included in the legislation were provisions to extend the E-Verify, Religious Worker, Conrad 30 and EB-5 programs.
The continuing resolution was attached to the FY10 Legislative Branch Appropriations bill (H.R. 2918), and was passed by the House of Representatives on 9/25/09 and the Senate on 9/30/09.
The E-Verify, Religious Worker, Conrad 30 and EB-5 programs have all been extended for an additional 30 days, though all they may be extended further in the coming weeks once the Senate and House conference the FY10 Homeland Security Appropriations bill (H.R. 2892).

i applied my wife's H4 visa renewal on Feb 2008 but received the USCIS Ack as April 2008. when i see the processing times now looks like the processing time for the I 539(H4 Renewal) is October 2007
Does any body have any understanding on the processing times on when my H4 Visa petition would be processed with USCIS ack date as april 2008 . any suggestions would be apreciated

Hi,
Can we apply for a new EAD/AP after they expire?
If so, what is the difference b/w applying for an extension vs. a new one in terms of fees/documents/photos/etc.?
The reason being I already spent $1000 for EAD/AP last yr. but never used it, and now I have bear all H1 (extension) expenses as well as employer sucked all my blood & is after my limbs after 8 years of slavery. On top of that has stopped paying salary since April.
Hence I am trying to cut corners whenever wherever possible. Any responses or help greatly appreciated.

Greencard requirement says one has to reside 183 days per year to maintain continuous residency requirement.

I am travelling to India in November 2009. My visa recently expired and I got my H1b extension until 2012. I work for a big US company of repute. Although my company has no TARP related benefits from the GOV, given the economic conditions, I am little concerned if Stamping in India for visa could be a problem? My concern is if they would deny or delay the visa approval? I have all my documents valid including employment status.My GC is under process(I-140 approved).
Additionally, what precaution should I take that enhances my chances of successful visa stamping?

I am thinking of starting a company in partnership with an American Citizen. I currently hold H1B visa sponsored by my employer. If i start the company in partnership, can my partner/ my firm sponsor my concurrent H1B once the company is setup? My job will be quite similar to the job profile on my primary H1B.
I know the easiest is to be a silent partner, but in my case i might have to be involved 5-10 hours a week. So i understand concurrent H1B in my case would be the best. Any advise or feedback is greatly apprecaited.

How are stamping scenarios these days at Chennai?..esp"lly due to PIMS stuff...
I have followed lot of discussions around H1 stamping and people got struck for weeks/months in India due to PIMS and other issues..
Is it advisable to go for H1 stamping as i'm into 7 th year of extension and I can't afford getting stuck in India for more than the granted period of vacation...I have approved AP documents handy and can use them while coming back to US...

Hi Gurus,
My PD is Aug 2005 (EB2 India). Last year, during September - October my case was picked up and I think it is processed, but because of lack of visa numbers, the case was not approved. (I wrote a senator letter, he got back saying that the file is processed and waiting for visa numbers)
Now, I got 2 offers. First one is a fulltime position and 2nd one is a contract with a primary vendor (directly working on W2 using EAD). I haven't decided which one to join.
What are the options, I have? Do I need to file AC21? Since my file is already processed and waiting for the PD to become current, am I OK, even if I don�t apply for AC21? If I file AC21 and if the job descriptions are not matching or because of any other issues, if there is an RFE, I will be having some issues.
Gurus please let me know your thoughts.

My I-485 is pending with EB3 Feb 2006 priority date. Invoked AC21 and currently working for a different employer. Have Masters degree and 9+ years of experience.
Is there a way to re-apply for Green Card under EB2 category thru a 3rd employer and retain the old EB3 priority date?

Our son was out of the country when we filed our 485 on July 2nd. Now he returned to US, how shall we file his AOS? Form I-485 or anything else? Shall we include a copy of our filing inside?
In addition, the I140 was approved after we filed. And the principal applicant went out of the country and applied H1 visas and returned also.
Shall we include the updated information of the principal inside or just the copy of the original filing?
