Check Murthy bulletin....Murthy explicitly asked USCIS to revoke this earlier decision of GC approval for a client whose PD was not current....a case very similar to yours...as they anticipated lots of issues down the line. The topic of the bulletin if i remember correctly is "when GC approval is not good news" or something.
This was a USCIS error and there's a high probability will be cought sooner or later, at which point USCIS will revoke their earlier decision.

The labor certification for a EB visa is based on a job/position requirement.
What is the intent of EB based GC?
How long is the person expected to the job for which the LC was approved?
Does that clock start when the LC was approved or when the i485 was approved?
If there is an drive for this effort, I will contribute.

There is another drawback of H1 that i have had for the past so many years, there is no change in the 'position' because it means that the job description will change, so all these years most people like me remain 'sr software engineers' no matter what we do, because lawyers say that you should not change the job description, as it will affect the process. its all a big scam i say... :confused:

Companies were vague on numbers. So how could they satisfy Senators. I knew only a few companies gave detail about open positions including Microsoft, Intel and oracle. How you can impress Senate or house? But anti immigrants gave all the layoff numbers, h1b numbers used and details of abuses happened for past few years. It is not just money power will win. With facts and numbers if you have money power then you can win. That is reason for past 3 years H1b numbers or GC numbers were not increased inspite of heavy lobbying.

Being an Indian does matter in this discussion....in most of ur post ...u r referencing people from ROW...I understand what they would be feeling...that FYI was for u to understand that if I could get offended then people from ROW surely will...
there r lot of people on EB3 ROW who are either nurses, engineers etc...They are well qualified...and u don't have a right to call them unskilled...Period..End the discussion

It is one way to reduce the budget deficit, each of us will be burning away $700- every year per head for AP + EAD renewal with close to a million applicants go do the maths.
And AP/EAD renewal cannot start before 120 days so that time period every year for at least 3 years they are gonna laugh their guts out.

Its very disappointing to me. My some of friends who filed labor just 2 months before me now will go citizenship for next year.
All EB3 who filed their I140/I485 in June and afterwards have to wait till processing date cross at least June. Right now TSC is processing April 2007 cases. I believe when both center starts processing July cases then you can see significant movement in EB3 cases. I think you need to wait till September when new quota comes. Till that time as my Atorney says focus and save your Jobs. Get more skill. Without good job all above is meaning less. Busy yourself in NFL, NBA, NHL or Cricket be cool and calm. Nothing is in your hand except waiting.

No one is talking about what happened in Apr-2001. Bill Clinton allowed all illegal aliens to file AOS in EB-3 category. That brought estimated 8-10 million filings in Jan-Apr 2001 under EB-3 category. That's why it took so long for EB-3 to get past Apr-2001. With EB-3 having a number cap, I still have a feeling that those estimated 8-10 million are still floating around in the system and dragging EB-3 category. Any thoughts on this?

I got to know from my attorney that, USCIS has my I 140 information in their system and they gave him a receipt number. But, the receipt is not generated yet. It may take a week or so to get the receipt. My appl was filed on 12th and it reached NSC on 13th.
I checked the status online with this receipt # and online status shows that they recieved the aplication on 19th and its at Texas center. May be my appl was moved to Texas now.
