GCTest and et al if you have really raised 600 $ talk to good lawyer to sure the hell out of USCIS for its un accountability. This EB3 - EB3 rift is not going to help anyone but only USCIS. Take a chill pill and think carefully who has screwed us most -- IT IS USCIS. If you sue USCIS for unaccountability, changing rules at will and worst of all racial discrimination or new term for country based discrimination -- it is history waiting to happen.
There is no value or point in creating Eb3 - Eb2 rift. No category is better than either - all are equally and royally screwed by USCIS.

A number of inquiries have come to us regarding delays in PERM labor certification case adjudication. Beginning early in 2007, there has been a noticeable slowing in case processing at the U.S. Department of Labor (DOL) Atlanta Processing Center. This center is one of two locations where PERM labor certifications are adjudicated. The other location is in Chicago. This slow-down is a marked change from the generally fast PERM labor certification decisions that had become the norm.

bad economy of 2009 is irrelevant to PD movement because of the huge backlog of pending cases. Just see the stats the USCIS had released earlier. Also, PERM applications dont take visa number. A visa number is allocated when a 485 is being approved.
So EBI reaching 2008 is almost certainly a zero possibility unless there are some legislative changes. There are simply too many pending cases from 2005, 2006.
Well, bad economy and less number of PERM applications in 2009 are very relevant to EB2I movement. Note that EB2I gets only around 3200 visa numbers every year in its quota but the number of spillover visas it gets from ROW has been around 12K-15K in past years. The visa spillover depends on how many visa numbers are left in ROW category. Less number of PERM applications in 2009 means less number of ROW cases filing 140+485 and thus less number of visa applications requested. Since, ROW is current, 140+485 can be filed as soon as the PERM is approved. PERM applications from ROW applicants filed in 2009 and early FY2010 will be able to move to 140+485 stage in FY2010.
However, movement of EB2I may be slower because of porting. Lot of people I know, have started the process to port their cases from EB2 to EB3 in 2009. This number can be substantial.

How come observations made over years on 100's to 1000's of students are "unsubstantiated"? Of course you may want not to believe me; that is your prerogative, and so is writing my own experience mine.
raysaikat - You must be kidding by trying to prove that you have taught 1000s of Anna/Osmania University students & number of them are bad as you described. You started in 100s & are now talking about thousands and I am sure if this argument continues you would go to even higher numbers just for the heck of proving your point. After all, its a matter of pressing few keys on your keyboard....but what credibility does it has when there is no way to validate??

Otherwise - Anna university is considered to be a top rated institute in south india esp., TN state. Osmania is also a very decent one (esp in Engg/comp sc). Both these universities are very famous for their ability to attract a lot of recruiters (All top indian companies + many MNCs as well). And here on this board, you just rule those out with a single word - Crappy!!

I have come across one interesting procedure in the USCIS website regarding beneficiaries of LPRs and I am asking a friend in the US in an immigration law firm to verify about this. I am just waiting for her to provide me the details and I will inform you about it since you can also be filed as derivative beneficiaries of your wife as an alternative way for you and your daughter to be with your wife.I do pray and hope she gives me a positive response.

I took out a loan from HDFC last year in India. Their service was decent and their rates were also low. No prepayment penalty after 1 year. You can check your balances online and they now offer electronic payments also. ICICI has higher rates, so I wouldn't recommend. SBI requires lot of paperwork and processing time, so you should weigh this in before approaching them.

The priority date based on the person first entering/start wrking for US on H1B visa, or converting to a H1 status from any other visa status in the US is an excellent one. This is good idea and fair deal to everyone which in turn follows FIFO method.

I have EB3 Nob/04 with I40 approved and AOS in progress.
Apllied EB2 10 months ago and got labor (6 months prep + 3 months in filling) + I140 approved (in 2 days)
with prem processing.
I'm also in the same boat as others, not clear as to what one has to do for porting/interfilling, I will let the attorney decide if he/she needs to submit a request or it will be automatically linked to the current 485.
Please keep us updated on your progress which is more helpful than attorneys and SOPs followed by USCIS, thanks.

When I started my process in 2005 I was told that the whole thing will take 2-3 years. It is almost 4 years now and based on the VB movement for the last few months I have been thinking that this process can easily take 6-7 years and now DOS says it may as well take decades for those born in India. :mad:
