    Thanks to all the moral support given by Chandvu,Pd Recapturing and all others.

    With all your wishes and almighty blessings today I got MTR approval and I485 into reopen status.

    My earlier employer revoked I 140 in Sept 08 . Applied MTR in OCT and got MTR approval and 485 reopened notification today.
    However online still not updated - may be site is still down.

    Hello guys,
    I had a strange issue with my wife previous H1-B.
    she came to US on H4 on 05.03.
    some x comapany processed her H1 and got approved on 10/1/2004
    and valid till 9/30/2007.
    on 1/2/2006 she change from x Company to y comapny and still working for y company.

    For applying for GC, i checked her online status for x comapny (old) in uscis site..found strange thing...her old employer did not receive any notice from INS...Please advise...

    Here are my observations:
    * Fragommen, National - if you sre shelling dough out of your pocket, stay away from them. They are a corporate law firm & if your case gets into a mess, you'll end up paying by the hour. Their rates are higher and you will not get personal attention
    * Greenberg Traurig, National - Dealt with them at a corporate level. Their team from DC did not have answers to some complicated situations that we had in our organization
    * Murthy, MD - Sheela is good. She is aggressive and creative but they don't pay attention to detail and have good churn in their staff. Take into account you will not deal with Sheela herself on a day to day basis, so no point going to her firm
    * Thomas Fan, MD - dude is in Baltimore. Avoid his firm like the plague. I know at least 2 cases where this guy has screwed things up bigtime AND washed his hands off the mess he created. These 2 cases eventually moved on to other firms & were successful
    * Ellen Krengel, CA - Ellen is certified to practice in IL but lives and works in CA. Very approachable, empathetic, she will research things for you and keep you plugged into the situation. Relatively junior attorney but is commited to the cause
    * Gowda, MI - Similar situation to Murthy. Firm's day to day work load is taken care of by junior attorneys not Gowda.

    I agree that porting to EB2 is the best route. But my company was very reluctant to file another labor to port my case to EB2. They thought thur PERM, they may have to hire some applicant if they meet the requirements. The lawyer thinks PERM is risky. I know they are trying to avoid EB2 labor at any cost, though I also know a few friends who had the PERM labor application recently rejected.

    Anyway, bottom line for me and others in the same situation is that we are stuck with EB3. And maybe stuck in the rut for a long long time unless something magical happens....

    All that is being said is very true. Petitioning the US gov't is as American as apple pie. As aspiring Americans we can only be respected for this, if we do it politely and peacefully.

    People who put in a herculean effort (not to be underestimated by anyone here) to organize the rally and surrounding activities, broke their backs trying to lay a platform for the rest of us to communicate our case. It is only natural that when they get the lamest of lame excuses, they feel upset.

    Every one of us has skin in this game. We need to find some way to lend our weight to this issue rather than just passing time on this or other websites. It is really unclear to me why in America, the most free society on the face of the earth, people feel unmotivated, inert, insecure etc to press what is a most legitimate grouse.

    Let me give you a few points that might convince you in this issue. For most of us:

    1) We are here at the behest of our employers or the US Gov't (NIW cases). Not on our own accord or illegitimately.

    2) The US gov't has certified that our jobs do not have suitably qualified americans to take them.

    3) The US Gov't has approved our immigrant petitions.

    4) We are in a period of inordinate delay to complete the steps due to a variety of factors, including bureaucratic delays, inordinately long security checks(BTW bad for both us and the country) and an inadequate supply of visa numbers for the number of approved petitions.

    5) We are asking the US Gov't to fix this issue and treat us fairly and not make us wait 6-10 yrs for no clear reason.

    6) We are asking them to be more straightforward in their policy and to stop sending mixed signals.

    Above all we are doing it in the most American of ways. Peacefully petitioning and lobbying the government. Most broad minded Americans can and do relate to this.

    I don't think Berry Appleman is a good firm, they took 30 days for all people to prepare simple docs for I 485 which takes 2 hours for us to prepare and they never respond to calls and email.

That's all I am saying. Anyway, my comment wasn't meant for you. You have shown understanding. I did see a few ppl earlier who literally asked ppl to "shut up and enjoy the ride". That really pi*** me off.

    Come on, man. We are paying too much attention here. Look, there is always somebody stuck somewhere. People are stuck in BEC, in other contries. People are stuck in Afganistan, Bangalore, there are hungry people stuck in Africa. So? If there are hungry people, then I can't enjoy my dinner then? Someone always has to come and say "you enjoy and there are people stuck somewhere"? What's your reaction would be if someone come on your wedding and start complaining that he is impotent? - these are a little extreme examples, just to make a point.

    Its really your judgement call if you believe whether IV is an organization that is helping BEC victims. I think the focus of this organization is retrogression relief. Nothing wrong or right about it.


    IV core keeps telling us, BEC is always on their agenda. Really? If they did not even understand our pain and consider our frustration a disruption to people's happiness, how can we expect them to help? I still think IV is a great org, as it's the first such organization to speak out for legal immigrants. But when it comes to BEC victims, I did not see IV changed anything, or intend to change anything.

    This is essentially what we got in July07, and this can be a great pain relief. Since it was done in July07, there is already a precedent for it?? Would it be an administrative fix then? Just a note , IV already has this as one of the things we are working to change in law, but I was wondering if it could be admin only fix.



    I initially posted below text to reply another thread, but the title is not much relavant. So I decided to create a new thread here:

    As a background, the pre-application of AOS (file 485 without PD being current) is mentioned in a DHS newsletter here (credit goes to kate123 for finding it).

    Legal Immigration Benefit Backlogs. What progress has been made in reducing the significant backlogs that had developed in the adjudication of naturalization petitions and adjustment of status (green card) applications? Which regional offices still lag behind in making progress toward target processing times, and what specific steps are recommended for providing priority resources to those offices?

    Please provide an assessment of information-sharing with the Department of State’s Bureau of Consular Affairs on projected adjustment caseloads, to be used by that Bureau in setting each month’s cutoff dates on waiting lists for immigration categories that are limited by a yearly quota. What steps have been taken and what further steps are recommended to make sure that the full quota of permanent immigration spaces is used each fiscal year? What regulatory or legislative changes (including a possible pre-application filing procedure for adjustment cases) are recommended to facilitate caseload planning and make optimum use of U.S. Citizenship and Immigration Services adjudication capacity?



    This is a great finding I've read that page, but never noticed the Secretary of DHS specifically mentioned Pre-Application of AOS. Now that they do have this in their mind, can we start working on that? I'd love to share a few thoughts I have on it:
    From the lessons we learnt from the past, the most important thing for this admin fix to fly is compromise: there must be kind of restriction for the pre-application AOS. A few examples I could think of are:
    - The person has been in the country LEGALLY for more than a number of years, OR
    - The PD are more than a certain number years old, OR
    - I-140 has been approved, OR
    - Must have MS or higher for a US college (just for argument's sake, please don't flame me).

    The key is to not allow everyone to file pre-application or it'll be drown in a media storm and draw backfires. Yet it gives you a certain promise that you'll be able to file pre-application once you are here for a certain period of time, so everyone has hope and those who has suffered more would have an almost certain chance to do so.

    IV core, should we work on this? This is the first time we see pre-application of AOS appears in official file and I believe it's a great opportunity.

    There is no way for a bank to know when you leave. You might leave on vacation or for a break. As per US law you can come to US after a year break outside US. How does anyone could know whether you are on one month vacation or in one year vacation. I dont agree with this unless it is explained clearly.

    My experience has been similar,although I took the e-filing route for my wife.
    Incidentally, e-filing is very convenient and takes less than ten minutes.....if you keep all the info ready. Apart from charging the right amount, the receipt also mentions where the application needs to be sent. There was some confusion when I was reading the paper-based form instructions, until I saw the receipt printout.

    After e-filing, took a print out of the receipt and added
    Copy of I485 receipt (I797)
    Copy of earlier AP
    Copy of marriage cert (I cant recollect why I began using it. This is the 3rd AP...renewed twice after the July 2007 filing)
    Copies of the passport pages
    Copy of I94
    Two photographs

    We mailed it on 16 Dec, and today it has been approved and mailed back.
    It was quite exciting to see the 'post-decision' bubble being filled up.

Its Free, if you read the EAD forms its clearly written that once some one pays $340 ( not other amount) it becomes FREE for ever. I just checked the EAD forms again before writing this post - let me PASTE from EAD forms if that clear the confusion.

    Renewal EAD: If this is a renewal application and you
    applying under one of the following categories, a filing fee
    not required:
    1. (a)(8) Citizen of Micronesia, Marshall Islands, or Palau;
    3. (a)(11) Deferred Enforced Departure; or

    If anyone knows the history, this is pretty much happenned to Family based visas. 20 years ago, it was as easy as 1-2-3 and ppl use to get GCs in matter of months or 1-2 years. INS realized this and they started imposing processing dates and delays and what not and as it stands today, it takes about 10 years to get GC on family based.

    They may have same plan in mind that instead of paying unemployment to PRs and Citizens, let's kick out the smart ppl who are stealing all the jobs and now their country is taking some of our businesses too.

    Also, as we know the severity of the retrogation is not completely due to visa number unavailability. USCIS never used the full 140k - many years - due to the inefficiency of their process, FBI name check backlogs, may be work force shortage etc. We are beginning to see some improvements in those areas. There is an increased awareness of EB backlogs due to efforts of IV. I would say, the future is looking promising.
