I am already in the porting phase. My EB2 labor is in process. I just hate to see those still in EB3 hoping their day will come. They need to port their applications right away, or those with recent filings using fake experience will be ahead of them coz EB2 gets processed first with all the spill over.
And I would rather help them than someone like you who would not even disclose your info. You are a clear example of someone trying to walk the walk of the illegal aliens.
And what makes you think it is silly socialist? Unless you are one of the new graduates with a bachelor's degree with 5 years of experience on your resume.

never worked for "employer x" after H1 transfer, perhaps you are out of status. What is your lawyer saying? You never transferred H1 back to emplyer#2?
H1 doesnt work as you are interpreting. OP was working for 'A' and had a valid H1. At some point of time, he got a job offer from X and had his H1 transferred to X. Even though his new H1 is approved, his old H1 is still valid. It is valid as long as OP doesnt join X. Since the OP never left A and never joined X, he was always in status. OP -> this should be a simple case. Since you have documentation to prove that you were in status always and since you never joined X , you dont have paystubs and that should be perfectly fine as long as you never left A.

what is the phone number to call uscis regarding the july 2 query.
Called uscis and asked what happens to the app already received by them?
The rep put me on a hold..(guess went and asked somebody) and answered that all the app received will be put on hold(not returned) and said they will not process ead/ap too.Di anybody else tried calling and ask the same?did they tell the same thing?Just want to know if i interpreted it right?

All three- Lofgren, Eshoo and Pelosi- represent the High Tech areas of California, Silicon Valley and the areas around it. I'm sure there are many immigrants/IV members in those areas. We need to have a webfax and phone campaign to get interim relief now. Folks in that area can viist lawmakers offices too. Maybe CompeteAmerica wants to recapture H1 visas and EB visas for high tech immigrants too??

I am very sorry to hear about your case. As others are pointing out - it is not all over yet. Make sure you get in touch with a good lawyer and take a good route to fight USCIS.
Also, could you please let us know of your PD? Doesn't look like you are current right?
As of September VISA bulletin my PD is current, its July 2006 under EB-2

Initially when I first got here, I was elated at a wonderful process to elect the President. It seems like the whole country was interviewing the person for a position. After having witnessed the one in 2000, 2004 and now this one, the entire questioning process is a waste of time and mere charade.
The issues at hand are so go damn complex where no one liners or one minuters could do justice. They always seem to have answers for every god damn question which is just impossible. Even the most intelligent person usually comes to an area where he has not framed his answer and would like to consult.
Specialized topic like Stem Cells to global issues of Global Warming, War, Poverty and very personal issues like religion and abortion, these folks seem to have the right answer in one minute.
By listening to their answers, you are generally getting deceived. While all this is said and done, people however 'third-world' or 'first-world' they are seem to vote for the party and not the person. So, war-mongers and most arrogant pricks would still vote for McCain and others may end up with Obama.
After all this rant, what does it mean for us in terms of legal immigration? Nothing -- coz you really do not know what they actually think and will do when they become one.

I flew Air France once in 2003. My connecting flight from Paris to Delhi got delayed by 12 hours. When I approached the Air France staff, they told me that since I had an Indian passport, I would have to wait out the entire time in the transit area. Meanwhile, they proceeded to make arrangements for other non-Indian passengers. They even refused to acknowledge my attempts to reason with them, either not replying to me, or replying only in French. I filed a formal complaint afterwards, but never got a reply.
I have travelled on numerous times since then, but never with Air France. I don't even consider them as an option anymore.

I have got an RFE for 485 application. USCIS is asking me for Employment Letter, Paystubs and W2 for the employer I NEVER worked. (I have typed exact message below)

Your post absolutely doesnt make sense. You are asking us here "485 RFE and USCIS asking paystubs for employer you never worked"
This does not seem to be a 485 RFE but a H1 RFE. Put some sense into the post before posting here and confusing people. How can yours be a 485 RFE when employer X never sponsored your GC and when USCIS is asking paystubs from Employer X for H1 transfer and when your GC is still running with Employer 2. Senseless post.

How did you calculate 50k? Just curious.
About 50k might be remaining visas alloted for EB2 India. These 50k are the spill overs from EB1, EB2 ROW and Family Based Unused Visas as well.
In July 2007 Fiasco there have been received about 300k 485 applications. And out of that Say 200k belongs to EB3 because in EB3 it includes India and ROW also. Where as In EB2 its only India and China. Because in EB2 ROW is already current. So I presume about 100k applications are from EB2 and waiting for visa numbers. So this year 50K spill overs +9,800 rgular allotment for EB2, totaled about 60k. So 60k of this year and next year clears off all EB2 applications and make EB2 dates current.

USCIS has absolutely no info about labor till the employer files a I-140 with a certified copy of LC. I would seriously doubt if that's the case, unless your old employer filed the I-140 using the 2004 labor and the I-140 was approved.
For your own good, you should get things corrected....the short term excitement may lead to more trouble later...just my 2 cents.

I had applied for I-140 in march 2007 in regular processing (not premium). its in nebraska center which i think is taking quite a long time. should i hurry this up by upgrading to premium and then apply for 485?? i dont want to wait cuz who knows those 485 dates might retrogress in a couple of months.
i wud highly appreciate any recommendations/suggestions.

in the MN chapter, it's hard to even get replies to e mails, forget meetings etc. of late though i'm glad to say the MN chapter has really beugun to pick up again.
ask the tri state guys how much effort they put locally- meetings- fliers- phone calls, all by a handful of volunteers. so all this is good in theory and yes it takes time. but the apathy (even hostility) that was encountered was frightening. ask chanduv23 someday what the tri state guys went through...

I dont think filing EB2 is that easy. First condition is not that candidate likes to be Eb2 that drives the labor application (I wish that was the case then every one would have asked for EB1) it is the job requirement that should be able to qualify for EB2. (for people working in large corporations this will be the stumbling block) for people in consulting business this is not an issue but in this tight market with A2P and wages could spoil the party along with DOL activism for audit does not mean things will be piece of cake. For EB2 from candidates side he/she needs to have MS preferably in same field as work ( So MS Mechanical working as DBA might face RFE to explain) or the previous work experience might be scrtunized more to validate it satisfies the labor requirements.
All Indians and Chinese will file only EB2 now onwards:D
