Most EB2's who are talking on this forum are idiotic, egostic and too much of themselves to think straight. Case in point Smugbee, SNathan and TonyHK. Since they don't have ead they want ead and thats all they care about. As long as they get to file 485 and get ead they dont care.
When an eb3 complains about waiting for GC he/she is a whiner and has to recognize the superiority of an EB2 getting GC before EB3 even if teh EB2 is 1 year in thsi country and EB3 has been waiting for 12 years.
When an eb2 complains about not having ead his concerns are valid and nothing else is more important on IV thean that
Eb2 are there in Eb2 for a reason and Eb3 are there in Eb3 for a reason.

I think they came up wit 5K figure just to say F.. off in a gentle way...They never thought that we'll collect 5K and give them. I really think this should be sent out to media and immigration subcommittees, complaining we are paying hefty fees to live in the country on the contrary we are asked for this kind of money to get information which USCIS should have been publishing atleast quarterly...

Murthy document does not say about the Company B H1B is NEW or TRANSFERRED.
If New H1B and Transferred H1B are same....then problem is solved.
Many of you here said both are same. I assume so too. But, we haven't proved Gapala is wrong yet (no hard feelings gapala. it is not my intention to hurt you). if 'NEW and TRANSFERRED' are different, Murthy should have mentioned in her Document, but she did not do that. So, can we safely assume, that 'NEW and TRANSFERRED' are same.

One thing I noticed in this thread is the lack of differentiation between attorney's who were hired directly by applicants as opposed to ones hired by the company one work's for.
I am sure there is wide gap in how law firms operate when interacting with either of the entities.
I would be interested in getting some references from people who have hired their own attorneys and their experience with that.
Even I am looking to hire an attorney to transfer my wife's case and then join the waiting game..

They filed my H1B and are about to start my green card. The H1B took forever. I wish my company allowed me to do the H1B myself. I can do a better job without a lawyer instead of paying Fragomen $5000 for rubbish.
Once, they kept sending out emails per my H1B application and copied my company using a wrong email address. This stalled my start date as my company never got these emails and I kept calling them. I thought my company was ignoring me but it was Fragomen that kept using the wrong email address.
I wonder if my company would allow me use a personal lawyer for the GC process.

Desi3933 cleared the 99% of the cloud surrounded this issue by pointing to murthy.com (I maintained valid status with 'Employer #2' and this doc says I am good to go). Thank you very much Desi3933.

this whole issue of undistributed visas has been going on since 2005. It was thoroughly digested/analyzed by many, many people. The discussions had a lot of infighting just like this thread does.
The law hasn't changed; therefore, a different interpretation leaves open possibility of lawsuits.
I read the law to say specifically that if there is more people in que for greencard then hard limit of 7% to anyone country. Until there is less demand for eb1/eb2/eb3 as a whole then hard cap.
2005 and 2006 the number of greencards issued to anyone particular company had 7% total. Last year; particularly the summer, visas were used to overflow to china/india when they shouldn't have because in september eb3 row was retrogressed and so was eb2 row. Under the law; if eb3 row is not current then there can be no overflow of visas.
Most of row has sat idly while the visas have overflowed when they should not have. All it takes is someone from ROW to sue USCIS over this. However; no one does simply because by the time the lawsuit comes; there dates would probably be current and lawsuit would go away.
as an fyi; i don't think anyone has posted but there has been some peoples greencards which were approved in september and october where uscis sent a notice to rescind because the date wasn't current when it got approved. USCIS does have a track record now of rescinding or starting recission procedures if they have made a mistake. My wife moved from H4 to H1 in June 2007 and obtained her SSN at the same time. We used her new SSN to file our returns in March this year. However, no sign of the stimulus package yet. Wonder how is our case being considered. Thoughts?

Would the employers exempt from "Immigration and Nationality Act" in any way ? I see so many job postings restricting with "US Citizens" only...

I am afraid my analysis reflect the reality. I have heard a number of people talking about this and polls have shown that is the case. Iraq war & scandals were the driving force behind this. Nothing else. Even liberal newspapers such as The Nation report that is the case:

Americans are really disappointed with the GOP in general and I personally know a leader of an anti-illegal alien group who voted against his Republican representative. That is true. It is odd, but that is the truth.

So your analysis is: people are unhappy with GOP that “some” of them are in favor of immigration measures and punished them by giving control to a party where “most” of them are certain to support those same measures ????!!!???!!! Its most illogical and even comical analysis I ever heard.
Elections show that American people are much smarter than some politicians/talk show/TV show hosts hoped for. True, elections are fought on much stronger issues like war, economy etc and exit polls have shows that people are not too concerned about illegal immigration issue despite of coverage given by likes of Lou Dobbs. Also based on the fate of candidates who made the immigration their main plank, it can be argued that majority is actually in favor of such measures…..election results are a lot complicated to say anything like that…..but….its a much more logical conclusion that what you were saying.
