    I wonder at what point of time this "three years of U.S. work experience" applies from. Is it that you should have 3 yrs exp when you applied for labor or is it when you apply for 485??

    3 years experience period. It is an add on to the point system, if at all the amendment passes. At that point, there would not be any of the labor-140-485 process. You will be exempt from visa numbers, who knows what that system would be.

    Yes immigration reform was on many of their lips....all we can do is hope they consider it sooner rather than later...but who on earth trusts politicians. I am still thinking that the embittered Democrats will try to strike hard blows to pave way for a Democratic President in 2008...that is going to be there main agenda - by repealing tax cuts, calling committees on War, etc to take the Pres to task....They have called that out too many times...for us to ignore that it will be their # 1 priority.

    Hi All,

    I am planning to apply for PIO card for my son born in last month. I would like to send the documents to CGO Houston. Can you please suggest what are the documents should I send. I see the information in their website but looks confusing regarding orginals or copies.

    I received PIO for my son last week; here are the documents I sent.

    1) 2 Photos only, Yes just 2 not 4, there are several discussions about it but 2 worked for me.
    2) My passport photo copy (first and last 3 pages only )
    3) My wife's passport photo copy (first and last 3 pages only )
    4) My kid's US passport photo copy (first and last 3 pages only )
    5) My kid's birth certificate photo copy.
    6) Utility bill (electricity original)
    7) $185 cashiers check
    8) $20 bill
    9) Application form.


    All the photo copy documents were notarized including birth certificate.
    Thumb impression of my son on the application form (on first and second page).
    Parents singature.

    And that�s pretty much it ...got the PIO in 2 weeks. I did send email to check on the application after 1 week of applying, but there was no response from the SFO office.

In 1994, the U.S. signed NAFTA, which promised, among other things, to help create a thriving middle class in Mexico. At that time there were 3 million undocumented workers in the U.S.; today there are more than 11 million. In Mexico, 9 million more live in poverty than when NAFTA was enacted. NAFTA has failed the U.S. and Mexico. By creating an atmosphere where Mexican citizens feel they have no chance of a successful life in Mexico, these ill-conceived trade agreements increase the number of illegal immigrants coming into our country.

    In addition to addressing the forces that are compelling illegal immigration, we must take action to bring illegal immigrants out of the shadows. While I do not support amnesty and have serious concerns about guest worker programs, I do believe our nation should consider establishing a process by which illegal immigrants can eventually earn citizenship. The solution to our immigration problem will not be a simple one, as many things in our country need to be fixed to stop illegal immigration. It is time to take a common sense approach to immigration reform.

    The Senate most recently considered immigration when S.1639 was introduced in the 110th Congress. On June 28, 2007, the Senate rejected a cloture motion to proceed to final passage of S.1639 by a vote of 46 yeas to 53 nays. I was deeply concerned about the guest worker provisions in this bill, and voted against proceeding to a final vote.     Guys, let me say something here.

    $5000 for one query is not an unfair amount of money. The reason I say this is because I know a thing or two about writing quality queries, I have done that for the last 6 years of my 9 year career querying the heck out of Oracle CRM.

    It does take time to write queries and the time it takes depends on how many pieces of information you want to bring together. The wider your spreadsheet is for the final output, the more islands of data need to be connected to fetch that output. Those who are familiar with SQL would know that I am talking about going thru potentially 20-25 tables and joining them to get data. This is probably not going to be a select * from 485_cases kind of query. If it takes 100 hours of time to write such a query, at $50 per hour of programming time, it could be 5000. Most likely it may be fewer hours if they have a programmer with knowledge on staff.

    The problem here is not 5000 dollars. The problem here is that the situation is hopeless because they dont assign country of chargeability to pending 485 cases up until they are ready to approve them, if I read it correctly. The data that is not captured is the data that cannot be queried, simple as that.

    And on that note, thanks to "Needhelp!" for shining some light on USCIS process thru her FOIA.

    Folks,
    It is very important for everyone to comprehend the difference between a litigation attorney & your regular immigration attorney.

    Your regular immigration attorney understands immigration law and will file your paper work, follow up with CIS, etc. Litigation attorneys handle litigation - they argue in court and fight for you.

    The two are completely different practice areas from what I have seen. Most of the cases that we come across are the regular Immigration Attorneys who will not go to trial if things get tricky.

    Please remember this.

    As I promised earlier I would keep you guys updated on the process of this case.

    On saturday I received the welcome as a permanent resident to USA letter. After trying to get a hold of my attorney I got in touch with him.

    Heres the story. (this guy is a genius)
    I asked him how it was possible when my PD wasn't current I got GC approval.
    His answer was funny and pleasant. Magic :D

    He said after the approval of my PERM during filing I-140 under EB2 he also filed a petition under "person with extraordinary ability interest to US" on my behalf. So in other words both the petitions were being processed together at USCIS. Me not aware of USCIS rules wasn't aware of all the lingo so didn't know.

    Now the Extraordinary ability petition quota is always current. So when my extraordinary petition was approved the attorney informed the USCIS that to adjucate my adjustment based on this approval. Since the PD was current for this category. USCIS processed and approved the GC based on that. I love this guy I don't have to work for my current employer anymore hence he will get a big surprise when I turn in 2 day resignation. HA...



    Congrats......this truly is your 4th of July.

    Congratulations to all IV members for being able to apply for I-485. This is GREAT news. Please please apply for your I-485 at the earliest. It would be best if your application reaches USCIS in the week of 2nd July. Here is the link to July Visa Bulletin:

    Kartik, as long as we, the EB3 do not come forward and collect huge amount for lobbying, we will continue to lurk here for many more years.

    Unfortunately the sad part is, whatever lobbying is done actually helped only EB2 I, may be due to a wrong notion by USCIS that all Hi-tech immigrants are EB2. This could be a fact as there are thousands of 245 cases that fell into EB3.

    Another bad thing was that USCIS release this VB yesterday which means one extra day to CRY.

    I do not blame any one, but ourselves. We do not want to spend money and hence dying in this process. No solution, but cry at every VB day.

    caliber, agreed with your comments. I also see here now we lost a buch of support from EB2 community because of one visa bulletin. People fail to realize come october 2010, dates will retrogress because spillover is applied at the end of a fiscal year and not the beginning.

    If EB2 community thinks they are going to get green card just because they got current, that shows how blind-sided they are about the process. Because getting current is only the first step. there are lot of members who have been current and have waited years to get green card.

    anyway, I guess for the next 3-4 months it will be EB3 community trying to lobby for changes and EB2 members looking at visa bulletin.

    It is sad USCIS has managed to bring this split into the community by playing with visa bulletin. Anyway, we will get everyone back in Oct 2010 when dates retrogress.

    No...I am not crying and I never did. I am secure with whatever life has thrown at me.

    I can tell your case. If you apply now by EB you will get gc within 3 to 7 years time. If you apply by point system after 5 years of USA experience and you will have employer sponsor you will have 16 points more than those who are coming fresh to USA. So both point system and EB system you will get at the same time period. Process delay will be minimal as no labor or I140. But initial period there will be delays as it is entirely new and untested. We cannot compare EB and point system now. Only point system comes we will know the problems

    First of all, it is not "my" case. I have been waiting in line for my green card for the past 5 years with my labor stuck in BEC. So, under the current CIR draft, I will be one of the biggest losers as I have not filed for my I-140 and so, my whole application will go down the drain after 5 years of time, money, energy and emotional stress.

    How do you come with a math where I will be able to get a GC immediately after 5 years if I apply under the points system? Did you even read the draft bill? How will I or anybody else for that matter, manage for next 5 years without a GC when they are squeezing out the H1B (fee increase, removal of dual intent etc)?? Next would be the per country hard quota that will put us in an eternally long line.

    I would definitely compare the current mess of a EB based system with the untested point system and take the current system any time as it is a known devil. The merit system is no angel either. Atleast in the current system, if I wait long enough, I know that my turn will come.

    How do you know that process delay would be minimal? USCIS's current delay is not because of process, it is because of the sheer volume of applications and lack of man power. The PERM system takes one month. If you pay premium processing, it takes them 15 days to clear your I-140. So, where is the delay in process? All the delay is from the past backlogs which this bill fails to address and at the I-485 stage where they have to do background checks. That will exist in the points system as well. After you discover the problems in the point system, what will you do then? Ask for another CIR bill??

    You don't have to tell what "my" case is. I live my case...

    I am not sure whether it is my HR to be blamed or my corporate law firm TheChugh who has been handling my case, no one has bothered to convey my PERM status or even my case #. I feel frustrated when my HR doesn't respond about the status.
    I understand that they must by flooded with application preparation but setting up a link for me to check the status shouldn't be very difficult.
    I really hope that my PERM gets approved before 31st July so that I can file I-140 and I-485 concurrently.
    Anyone else has experience to share about TheChugh law firm?

    I already mentioned in my previous posts (multiple posts with same matter for people like you and me, see it and understand it well) how we are getting more than 50k visas just for EB2 India. I am giving it here again the visa allotments for 2006 and 2007 years when theres vertical fallouts. Now its changed to horizontal fall outs.

    Due to this as many of us think its not the EB3 India which is losing, but its EB3 ROW.



    Class --------------------------------------> 2006 | 2007

    Total Employment-based Approvals ----------> 159,081 | 162,176

    EB1 ---------------------------------------> 36,960 | 26,697

    EB2 ---------------------------------------> 21,911 | 44,162

    EB3 ---------------------------------------> 89,922 | 85,030

    Fourth:-------------------------------------> 9,539 | 5,481

    Fifth (investors) ----------------------------> 749 | 806


    See the Total Employment Based Visa approvals for 2006 and 2007 159,081 and 162,176. But there are only 140,000 visas in EB category. The rest of the visas came from Family Based visas which are not used for the previous fiscal year. The share for each category: Each EB1, EB2 and EB3 should get 1/3 of 140,000 = 46,666. But due to the less demand in EB1 and EB2 ROW all the visas falling to EB3 ROW due to the Vertical falling.


    EB1 ROW --> EB2 ROW --> EB3 ROW.

    EB1 INDIA --> EB2 INDIA --> EB3 INDIA.

    As theres not much demand for EB1 ROW and EB2 ROW, all the unused visas are going to fall to EB3 ROW. So from this time its going to be like Horizotal fall out like below.


    EB1 ROW/EB1 INDIA --> EB2 ROW/ EB2India/ EB2China-->EB3ROW/EB3 INDIA.


    So this time to fall any VISAS into EB3 ROW they have to pass through EB2 India/EB2 China. So this makes EB3 ROW dates would retrogress due to the decrease in visa numbers availabilty.

    As I said each category would have 46,666. So EB1 and EB2 together will have around 93,332 visas. But in EB1+EB2 in 2006 about 50,000 visas approved and in 2007 about 70,000 visas approved. So for 2008 also asume the demand for EB1 and EB2 is 70,000. But the availability of VISAS are 93,332 as said above + unused family visas which come around 19,000+.

    So for this 2008 fiscal year for EB2 India and China the total visa numbers availla ble are


    (93,332 +19,000) - 70,000 = 42,332.


    So around 42 thousand + 9,800 (regular 7% of 140k) = around 52k Visas Just for India , because EB2 China was already Jan 2006 a year back. And I dont think it would take any considerable share in this 50k other than its regular 9,800 visas.


    Get me back if you have any doubts.

    I see ur predictions coming true, but with a big BUT, the flow "EB1 ROW/EB1 INDIA --> EB2 ROW/ EB2India/ EB2China-->EB3ROW/EB3 INDIA." may be a make-shift approach just to use up leftover visas for this year. This is not a published rule anywhere. So how can u be so certain based on Ron Gotcher or how can he be so certain that this gonna be the approach going forward.

    If u made this prediction based on the above rule, then where did u get the news that the visa flow will be changed from vertical to horisontal???? Or was it just a fluke????

    We have being diched by USCIS/DOS so many times that i believe such move "too good to be true". It seems like this VB is also like the July07 where everybody when current with the difference that only EB2 IC are forwarded.

    You need to file for I-140 before 10/1/07.
    For that you need to have an aproved Labor.
    Bear in mind this is just one of the opinions out there (albeit the most prevalent)
    Nothing is final yet, untill CIR passes both houses and signed by the president before 09/30/07. (Though it looks highly likely now)

    I have gone through the text of old bill (page 265) and new bill (page 291). There is no difference b/w the two.
    I believe cut off date will be Jun 19, 2007.
    Please read page 286, line 40-44 and then read Section 502 d, on page 291 line 40-44.

    My PD is Dec 2006. I got my EAD 15 days ago and the card is valid for 2 yrs. So the guy that approved my card doesn't believe Dec 2006 is a possibility this year!

    I want to thank this european who got his greencard 2 weeks back but still attended the rally. There may be more heroes like this. I was in a group of people when we spoke to him, didnt catch his name as i was encouraging bypassers to honk their cars to support our cause.

    He is over 6 foot, in immigration voice t-shirt and blue jeans. He is swedish...Please share his name if anybody knows....
    I was the guy from Sweden. I agree with the Russian student.
    The reason I was there was because my green card process was a painful and stressful experience for 5 years. And I was still one of the lucky ones! I don't want to put anyone through the same agony, not even my worst enemy. I really feel for the people still stuck in the mess.

    I talked to a Polish guy who had been here 9 years fully legally and could not leave. He had not seen his family in 9 years and did not want to risk going back just in case they would not approve his H1B in his home country. They are very strict there it seems, because none of his family members or friends could not even get a tourist nor visit visa to see his graduation. Shocking!

    I was glad I showed up at the rally just to hear all the peoples' stories.
    Most people who did not show up probably think they are ok after applying the i485. They will join IV rallies, when they realize how wrong they are. People have applied for i485s years ago and still don't have a green card...
    You are in trouble until you get your green card in your hand.

    If you have not contributed yet: This is money well spent. Changes has started to happen already, thanks to IV. Just renewing AP, EAD, H1B every year will cost a lot more than this.

    There was another russian gentleman who got his green card 6 months back and is a student now. Yet, he had driven 3 hours from NJ just to cheer us. He mentioned that he understands how painful this process is and wanted to encourage us by attending.
    I met an Indian who got his green card in year2003. Still he attended to give moral support to IV. Hats off to all those guys who made it to the rally even after getting there GC's. Hopefully those people who are still stuck in the GC mess realize the importance to actively participate in the events organized by IV.

    Franklin, yes, Ombudsman report includes ALL I-485 numbers, plus ALL naturalizations. Among all of them EBs are a small number.

    What I was trying to understnd by running the numbers, where does the "leacky bucket" go over time. Imagine EB category as a leacky bucket - new workers on H1Bs are getitng their documents done, that goes to adds, and approvals are being given out, that goes to substracts. If the expected new petititons being ready are more than 140K, the total bucket will grow. If it is less, it will shrink. What I am basically saying, it is between 10K and 20K less adds than deletes, so the backlog should shrink over time (not tomorrow, of course). And it will start shrinking from EB3 ROW, because that is where the unused numbers end up. By watching EB3 ROW number we should be able to tell how fast the pool is shrinking.

    Also, in the concept of the leaky bucket, it becomes essential not to lose any numbers, this is why 10K lost numbers a year is unacceptable. Personally, I think advocating number recapture is a waste of time (better off advocating quota increases), but we should be vigilant about CIS not losing numbers going forward.

    Efficiency of precessing, in my opinion, is not an issue at all, at least on the USCIS side. FBI is a different story, but even for them, it is rare that cases are stuck for more than two years. Retrogression is the real culpit - being stuck in retro for 5 years is not unusual, and this is a whole lot worse than namecheck. By the way, because naturalizations are also subject to namechecks, there is enough outrage out there that I think namecheck issue will be solved in the next year or so.
