    It's not change in leadership, but a change in the quality of membership that is needed! As somebody mentioned, we need members who are patient and can contribute constructively and most importantly trust the folks who are leading from the front to do what is right.

    Really have a feeling that most of all this stink and nonsense is being propogated by folks from programmers guild/numbers USA. Not a day goes by without somebody posting a distracting message.



    I think a change of leadership of IV is critical if we have to get anywhere. IV has not been able to achieve a single thing in all of its existence. Not a single thing, nada, zitto, zapata. Not disclosing the issues they are working on, not disclosing how the funds are distributed, not disclosing the lobbyist they are using. Who in the world calls that leadership!

    That is the reason that no one wants to contribute. First get some results, show people results for what they have paid for. Then ask for more money. Most people I talk to are confident that IV will achieve nothing given their track record. I tried to convince a colleague to join IV. He bet with me that they will not be able to achieve even this filing I-485 issue. He bet that he will join and pay if they did.

    I know IV works like dIVorced wIVes club and saying anything negative is taboo. Anyone saying anything negative is crushed with (p)curses. Only good mushy things are allowed here. So here it is: We will get our GCs by the end of the month. Hallelujah!

    But I am writing this for the benefit of IV and please take this as constructively as you can. As a member, I have full right to suggest a change of leadership when I think it can help.

    Having an approved 140 and a 485 pending for more than six months is the safe method of switching. For AC21, the key is to have your 485 pending for more than six months. You can use AC21 to switch employers after six months of filing of 485 even if your 140 is not approved. Its not a simple process but folks have done it.

    (1) Write down the number and what you want to speak in a piece of paper

    (2) If you are working, you may want privacy. Step out of the office for a 10 min break with your cell phone

    (3) Go to a calm place - could be a garden or a lobby or a rest area or a parking lot or inside your car.

    (4) You can also go for a small ride in your car (make sure you have hands free or bluetooth)

    (5) Just call the number

    (6) There is a person on the other side who is very much human like you

    (7) This person is a staff and is doing his/her duty.

    (8) Speak out clearly - have a pleasant conversation

    (9) After the call - feel proud you are a part of democratic process

    (10) Update folks on IV that you proudly finished an action item

    (11) Encourage others to do this

    I cancelled my tickets because of the FP appointment I had on same day.

    You could have called the local finger print office, and asked to move to another day because of travel. They let me come in 2 weeks early because of a flight. I had tickets in hand but they didn't ask to see.

    I persuaded my manager (US Citizen) and he called as well ( I was present when he called). He voiced his support. Also, had my other colleagues call in as well.

    Planning to call my friends and relatives (US Citizens) and ask them to make the calls.

    I agree with you, my first reaction too was that this is practically impossible. Bill Gates was suggesting the proposal of "Instant GC" for anyone who completes their Master's degree in US. So may be some day this will become a reality.

    I dont know how they are going to deal with immediate family members in that scenario. This does not sound like a bad idea but not everyone is lucky enough to afford doing their Master's in US. A number of them come on H-1B visas. Bill Gates was not against H-1B program.

    I think there is a general consensus that H-1B program is being abused by employers. IEEE is suggesting to wrap it up while others are suggesting to keep the program but fix it, by providing the flexibility based on the current market needs and enforcing tough monitoring on the employers.

    I must agree that the document is a perfect representation of how the H-1B program is being abused, which is unfortunate!

    I have not received my stimulus check yet. Here are the details:
    Paper filed the tax returns early February.
    Opted for direct deposit in the checking account.
    Last 2 of social security are between 39-50
    According to the following link http://www.irs.gov/irs/article/0,,id=180250,00.html, I should have received it by now.
    I am wondering if some one else is in the same boat & has called the Rebate Hotline at 1-866-234-2942.

    It looks like some lawyers maybe posting messages about their law firm here and advertising here, or asking their clients to advertise about them on the forum and get discount. So I guess we should only trust senior member postings and trust the postings where people talk about bad lawyers

    My company started the PERM process for me about 2.5 months ago. I contacted Fragomen about 1.5 months after approvals within the company and they said they are working on establishing min requirements for the position. I then contacted them 3 weeks after that day and they said they have established the requirement and will request the DOL for prevailing wage info (this was 2 weeks ago). After which they are going to start the recruitment process. So I'm not sure if the time line is okay or should I be chasing them more frequently? Please advise.

    We all know its not an easy 1-2-3 to happen in a jiffy for something to be debated in the Capitol hill...signed by the President..and becoming a law, against all odds of gas hikes,natural disasters,anti immigration...Immigration stands on a scale of 1 to 10,maybe number 9 or 10.

    Something has to happen which may run into years, here we are already worn-out with exploitation from our employers being on H1B.

    If one is below 30-35 he can go right away to India where it is booming,others beyond 40 are confused to go back, trust me..

    1)it will be a whole new struggle there with all the youngsters in the job market back home

    2)kids r already sort of grownup here..they need to be adjusted to the schools/curriculum there...

    might sound the most silliest... 3) I simply cant drive in the traffic there..no matter what..??!! I feel highly handicapped there without commuting.

    EB3 porting is a loophole like labor substitution.

    when I came here 6 yrs ago, I had the option of applying in EB3 with a top 4 consulting US firm and I did not want to go that route. I waited until 2010 to apply in EB2.

    Looks like People should come to the US as freshers or with 1-2 yrs experience > Apply in EB3 > Gain 5-6 yrs in experience > Port and BOOM, you have your GC.


    How can people claim PD porting at a later date when they were not eligible on that specific date in the first place at that time? I know it's legal just like Labor Substitution.

    IV is basically saying EB3 folks stop all initiatives. Rather convert to EB2. It's comfortable to say IV core and decisionmakers are composed of EB2 folks.

    McCain was always supportive of H1B and EB Green Card issues whereas Obama is not very supportive and would relegate the decision to his buddy senator from IL, Dick Durbin who sponsored the strongly anti-H1B Durbin-Grassely Act

    I second this opinion. Republicans in general and John McCain in particular are in favor of EB immigration (going by their actions). Dems tend to be pro-labor and anti-immigration.

    I wish there was a better way to establish priority date other than an approved I-140. Anyways...

    I am worried that if I get laid off or other people at our site are laid off, how will it affect my I-140 processing which is pending at TSC? Has anyone been denied I-140 because of layoffs by the company?

    The company said they will not revoke the 140 application and will send me the approval if it comes later (so I can at least retain the priority date if I have to do this all over again at a new company).

    Another thing that worries me is that the company is refusing to do premium processing of the I-140 application, even if I am ready to pay for the premium processing fees. I am at loss how to convince their dense mind what it means to lose the priority date.

    Green card processing can be for future employement also. So even though you laid off it won't stop your 140 processing.

    About premium processing Can't you deal with lawyer directly? . Just sending 1000$ check will do your job but I am not sure there is premium processing for 140 is valid now or not ? (until July 16)

    My current H1B was sponosred through an educational institution and was hence cap exempt. Will I be able to transfer my current H1B if I decide to move to a private company?
